What you're calling "the law" here is a very interesting area. It's the power of a Judge to jail someone without trial or due process. I never have liked it. Think it's totally inconsistent with the idea that we're supposed to have a right to trial and a jury of our peers and all that. There's now due process here. There's just a government official throwing someone in jail for not doing what he said to do. And it's indefinite. It's one area of the United States legal system that's always been very bad.Grizalltheway wrote:Nope. And yes it's a political prisoner. It's not "the law." It's Judicial edict. That's what the whole thing about forcing States to recognize homosexual marriage is. The idea that States are really required to do that by the Constitution is a joke. It's purely political. Philosophical.

And BTW there are political prisoners all over the world who are imprisoned because they violated "the law" in the countries in which they reside. The fact that someone is in prison for violating "the law" does not mean they are not a political prisoner.
What's said is that we have gotten to the point in the United States where "the law" is corrupted by the Judiciary so that now we have a political prisoner of our own.

Re: Kim Davis Jailed for refusing to obey the law
The Judge obviously made political calculations. He did not want to fine her because he knew she'd be financially supported. He did not want that to turn into a thing. You guys may not want to admit it but the woman is a political prisoner. She's in prison for political reasons. You cannot isolate "the law" from politics and philosophy.
You know if someone in Korea says the Beloved Leader is a dick they are thrown in jail for violating the law. And they are a political prisoner.
This woman is a political prisoner in the United States. We have come to that.
What we really need in this country is to have the other branches of government muster the guts to slap the Judiciary back into its proper role.

John saying something over and over again helps me understand better...
So you're saying what exactly - that she's a Political Prisoner - did I get that right..?

Oh... and
Both parties involved (her and the Judge) have made calculated decisions
and I've spent the night in jail without "due process" before as well

Well then, we have millions of political prisoners in jail due to the war on drugs. Drugs are bad so lock them up...it looks good on your resume. Why aren't you championing they're cause?JohnStOnge wrote:The Judge obviously made political calculations. He did not want to fine her because he knew she'd be financially supported. I'm glad to see that we're back to enforcing the law in this country! This is definitely a good start
I'm also glad to see that Jon, et al are for law and order again.
I expect to see mayors and councilmen in sanctuary cities jailed, Hillary Clinton jailed, DC bureaucrats refusing to issue concealed carry permits - jailed.
Because we are a nation of laws, right?

I do agree 100% that Davis was in the wrong and deserved a punishment and/or removal from her position.
However, when we talk about laws & political prisoners, let's try not to sound like hypocrites when we judge say a country like Iran for jailing people, Americans or not, for breaking their laws.

Failing to uphold the law and violating someones civil rights ( Gay and Straight) because I don't agree with the law. That will get you thrown in jail. Especially, when you been told to comply. Contempt of court. Deal with it.

Underline added for emphasis. You don't have to be in a facility labeled as a "prison" to be imprisoned.

Re: Kim Davis Jailed for refusing to obey the law
What we have in this country now not the rule of law. It's the rule of judges. I chuckle when I hear people say that we are a country of laws and not of men. That's a complete joke because we have "men" who can say the law says whatever they want it to say. And they do. I say "men" to include women who are judges and particularly people on the United State Supreme Court. The Law...as in what is legislated, what was established through the original Constitution and the subsequent Amendments...does NOT rule. The Judges control the Law and the Constitution rather than the Law and the Constitution controlling the Judges. And I don't see how anybody can even argue otherwise with a straight face.Im just amused that nobody gives a damn about the rule of law in this country unless its their own ox getting gored

Re: Kim Davis Jailed for refusing to obey the law
Yes but in most cases they have a right to due process so that they can eventually try to get out. If you're arrested for burglary you probably go to jail. But even if you can't or don't try to make bail the end game is that you have a right to a trial at some point. That's not what happens with Contempt of Court. With Contempt of Court a judge just decides he's going to jail you, imprison you, or whatever word you like. Then you're there indefinitely with no right of due process at all. A judge can put you in jail because he doesn't like the outfit you're wearing in the court room if he wants.Okay, then people are "imprisoned" every day without having a trial.
Just one more area in which we give Judges way too much respect and power. It's this little group in society we treat as though they're some kind of royalty; especially on the Federal level where there is absolutely zero accountability.

Re: Kim Davis Jailed for refusing to obey the law
This is nothing new for me, BTW, I was writing editorials about the inordinate power allowed Federal Judges in the McNeese Contraband (school newspaper) roughly 35 years ago. Writing about how they were totally out of control, how they made no pretense of actually sticking to the Law and the Constitution, how they essentially constitute an oligarchy.
Amazing to me that people who ostensibly believe in the right of people to representative government and accountable government tolerate what the institution of the Judiciary has become and have tolerated it for a long time.
To me the situation is summed up by this famous Justice Charles Evans Hughes quote:

That is a totally intolerable situation. It is the tail wagging the dog. Bass akwards. The Constitution should determine what the Judges say rather than the Judges determining what the Constitution says. And that's not what we have.We are under a Constitution, but the Constitution is what the judges say it is.
