I'd be willing to bet State Guards are considered unorganized militias and not a group of gun owners patrolling their hometown.
Where does it say congress decides who is and who isnt a militia? Congress doesnt create militias nor can they.

No, it's a difference of interpretation. Quit being obtuse.

By calling on all able bodied men to muster at a specific location for defense of the state, would that not be the Government creating a militia?

Since I'm 30 and able bodied i'm part of the "unorganized militia." But i'm not part of some paramilitary reserve force that works outside the federal government.

I have no issue with you and your buddies recreating the Militia of Montana. That's perfectly legal. But to say the Congress cannot organize it's population into militias (if it were needed) is just false.
