So after Thur's trial you were thinking manslaughter is what he would be found guilty of. After Fri you don't think that anymore? Was there some game changer on Fri?
No, there was no game changer. I don't think there is any way he is convicted of 2nd degree murder. Sorry I wasn't clear.

I think the judge will give the jury the option for manslaughter, and given that option I think they will convict him IF the DA has actually made the case for that. At this point it is hard to say, but I think the state will do everything humanly possible to put Zim behind bars to appease the black community. With that in mind I think the judge will tee up the jury for manslaughter and they will be more than happy to convict on that.

I was just reading the blog of the afternoon testimony today. The lead investigator Serino, on the stand a second time - this time for the defense, just said that when he played the 911 call to Trayvon Martin's dad and asked him if it was Travon screaming he said "no".

The Prosecution obviously realizes the weight of this and they are hitting back the best they can:
2:14 p.m. ET: "You stated it was under his breath," said de la Rionda.

"Yes, sir," said Serino.

"You interpreted it as he said, 'No,'" said de la Rionda.

"Yes sir," said Serino.

"You didn't flat out hear the word 'no' unequivocally?" asked de la Rionda.

"I heard it and saw the movement of his mouth," said Serino.

"Your opinion is he said, 'No,'" said de la Rionda.

"Yes sir," said Serino.

Serino agrees with de la Rionda that saying, "No," could be seen as denial when being told or hearing that a loved one is dead. De la Rionda has concluded his cross-examination.

2:25 p.m. ET: The defense has called Doris Singleton to the stand again. She says she was about 8 or 10 feet away from Serino and Tracey Martin when the 911 call was played.

"Mr. Martin’s response?" asked O'Mara.

"That it was not his son," said Singleton. "He has his head down, he was wiping his face with tissues." O'Mara has finished his direct examination.

A hung jury might even be worse, in terms of rioting. It just sounds more dramatic, and with the mentality of people who don't even realize that Zimmerman is Hispanic, they probably think a hung jury has something to do with lynching.

We are all looking at this from the prism of the news medai so I have to keep that in mind. But for the life of me I can't understand how anybody could eve rhave thought that there would be sufficient evidence to convict Zimmerman of ANYTHING in this situation under the "beyond a reasonable doubt" standard.

It may happen. We'll see. But I don't see how you can take somebody who'd obviously had the crap beaten out of him in a situation where he is the only witness to what happened and prove beyond a reasonable doubt that he didn't fear for his life and shoot in self defense.

I mean, if you really stick to what the standard supposed to be. I've heard nothing at all to indicate that they've had any evidence at all that what Zimmerman said about the situation isn't true. And the burden of proof is supposed to be on the prosecution. Zimmerman's not supposed to have to prove he's telling the truth. THEY'RE supposed to have to PROVE that he's not.

Because there isn't, there never was from the beginning. The state has no case. That's why they are attempting to appeal to the emotion aspects of the trial moreso then actual evidence.

The prosecution swung for the fences and turned this into a complete clown show. :ohno:

Trayvon's father's quote that is was not his son was a very small blurb in the newspaper several days after the shooting...and I pointed it out in a thread on here at that time.

Go figure, it didn't get major play on TV or on klean radio because it would have spoiled their story. :rofl:

In spite of the prosecution stepping on their own collective sacks in this case, Al is charging forward.
I distinctly remember the day that attorney Benjamin Crump and the parents of deceased victim Trayvon Martin approached me and asked that I use the power of NAN to bring national attention to the fact that their son's alleged killer, George Zimmerman, had in effect been exonerated by the Sanford Police Department before they even buried their young child. I was not aware of the incident, but was outraged when I learned that the police let Zimmerman go free the night of the shooting because of his version of a story that he had told them. The Sanford police let this man walk away before they even identified the body of the victim, or before they could decipher whether or not Zimmerman had been in a feud with the deceased, or any number of different scenarios. Zimmerman was told that he could go home, and return to the tragic scene the next day and recount what took place. Trayvon's parents, their attorney and members of the community were furious and said the Sanford police would have never behaved in this manner were the victim White. Their contention and mine never was that Zimmerman's actions were race-based, but rather that the police department's actions and mishandling of the situation were race-based. Given the history of Sanford PD, their objections seemed well placed.
