Hey dooshback, Simpson didn't call Santorum disgusting as you state in your thread title. He said something Santorum said was disgusting. Big difference. But accuracy wouldn't have been good for your thread title now would it?

Preachers in the south said it was immoral for blacks and whites to share facilities. Should that have been left to the states?

In Loving, the law created a distinction based on race, in violation of equal protection, by outlawing interracial marriage.dbackjon wrote:And Loving v Virginia?JoltinJoe wrote:

Lawrence v Texas?
In Lawrence, Justice Kennedy held that the law outlawing sodomy did not advance even have a rational basis. Therefore, since there was at least a bare liberty interest at stake, protected by the 14th Amendment, the law did not pass constitutional scrutiny.
Honestly, his decision was a mess from a constitutional perspective. Either hold that homosexuals are a protected class and the law does not pass strict scrutiny; or uphold the law. IMO, you could make a plausible argument that homosexuals have been the victim of historic disparate treatment at the hands of the government and can be recognized as a "protected" class (notably in government's denial of certain benefits which married heterosexuals can obtain). Granted, government has never passed laws preventing them from voting, or hindering their ability to vote, or denying them equal educational benefits (the type of typical tests by which you establish a "protected" class). Still, the argument is plausible and within recognized precedent. I think what Kennedy did in Lawrence was a bit dishonest.

I liked Simpson. He was a good friend of Delaware's Bill Roth (a native Montanan, BTW). Both were solid fiscal conservatives who respected the environment. Roth never engaged in the social issues crap.

States' rights extends to those things not reserved to the federal government and must also not circumvent the Constitution. So, yes, it WAS left to the states, but segregation was not Constitutionally supported and that's why it died.dbackjon wrote:So Joe - where do you draw the line between civil rights and morality?
