PORTLAND, Ore. (AP) - An Oregon medical marijuana patient who was badly burned in an explosion while he was legally using butane as a solvent to make hash oil is suing the makers and sellers of the fuel.
Kevin Tveisme, 28, of Portland, was injured in 2013 when his furnace clicked on, igniting butane vapor. The explosion destroyed his garage and injured a friend, Joseph Westom, who died 18 days later.
Treating marijuana with butane as a solvent extracts the potent hash oil at a low cost, but butane vapor is volatile. Explosions have become more common with the spread of legal medical and recreational marijuana.
As a medical marijuana cardholder, Tveisme was allowed to make hash oil under Oregon law, the lawsuit says.
Although the butane canisters had a “flammable” marking, the lawsuit says, the butane should have come with stickers and instructional brochures specifically warning of the volatility of the butane’s vapor.
The lawsuit also says the odorless butane should have been treated, like natural gas, with a smelly chemical to make its dangers obvious. The lawsuit was filed Wednesday in state court in Multnomah County. It seeks $11 million in damages.The suit was filed against a dozen defendants, including Shell Oil Products, a California-based distributor, and a Shell station in southeast Portland where the lawsuit says the butane was purchased. The owner of the store couldn’t be reached for comment.

Recently, Clinical Pediatrics published a study which showed that there was a 147.5 percent rise in exposure to Marijuana in children under the age of 5. The exposure level reportedly rose by 610 percent between the short time span between 2006 and 2013. The study also found that these numbers were higher in states that had recently legalized Marijuana for recreational use. As a whole, states where Marijuana is legal, saw a 63 percent increase in exposure in children under 6. Nation-wide, 75 percent of the under aged children exposed were ages 3 and under. Though exposure through indirect contact is common, many of the children’s tests proved that the drug had been directly ingested. Henry Spiller, co-author of the study explains what could be causing this rise.

The study also found that combining cannabis and alcohol decreased motor skills even more than just one or the other

Banda’s condition was devastating. According to the Crohn’s and Colitis Foundation of America, Crohn’s is a chronic bowel disease that causes inflammation of the intestinal tract and produces an intestine that can no longer adequately absorb food and water. This can result in mild to severe diarrhea, abdominal cramping, blood loss and anemia, as well as joint pain and swelling. Banda says her joints were in so much pain that she did most of her parenting from the couch. But it all changed when started using cannabis oil.

“I’m not in my deathbed, I’m working for the first time in four years, I’m hiking, I’m swimming, I’m able to play with my kids, I’m able to do things — I love it,” Banda said.

She didn’t do much to hide the success she experienced from self-medicating with an unjustly illicit drug. She documented her experience in a memoir titled “Live Free or Die,” and also in a 2010 marijuana documentary on YouTube. She tried moving to Colorado to take advantage of the state’s drug laws, but simply couldn’t afford to move with her two kids.

Things took a turn for the worst when her 11-year-old son challenged drug “educators” at his school who were regurgitating refer madness propaganda to his peers. He experienced his mother’s disease go into remission because of the cannabis oil she had been using, so he voiced his opinion. That came with dire consequences.

Administrators called him into their office and asked how frequently his mother was using marijuana. Soon Child Protective Services were notified and Banda quickly lost custody of her son. CPS then notified local law enforcement, and a warrant was obtained to search her home. Authorities discovered a little more than a pound of marijuana and equipment to manufacture cannabis oil. The police said that the items taken from the house were “within easy reach of the child.”

Banda turned herself in last Monday, and posted $50,000 bond with the financial help she received from a GoFundMe account set up on her behalf. But the fight is far from over. She still doesn’t have custody of her son, and faces a maximum of 30 years in prison.
