What that accomplished was an "over correction." It led to some very onerous intrusions upon Liberty. Stuff like the Federal Government telling a private business in Alabama or any other State that it can't deal with who it wants to deal with or opt NOT to deal with who it opts NOT to deal with is outrageous. There is nothing actually in the Constitution that gives the Federal government the power to do that. That's not regulating commerce. The power to regulate commerce is not the same thing as the power to force someone to engage in commerce when they don't want to.

There is absolutely nothing in the Constitution which, for instance, gives the Federal Government the power to tell a restaurant in Little Rock Arkansas that it can't opt not to serve Blacks. There's stuff about what States can and can't do thanks to the post Civil War amendments. But nothing about private businesses.

Whether it's morally acceptable for a restaurant to opt not to serve Blacks is another issue. The point is that the Federal Government shouldn't be involved in that. It's beyond its true Constitutional authority. Also involved is the idea that people have...or should have...the right to behave immorally as long as they are not positively attacking someone else. And you're not positively attacking someone by opting not to deal with them. You should be free to do that.
