A friend of mine, an Episcopal priest summed it up in one of op-eds at his parish website as it related to the Supreme Court's May decision of public prayer:

- "The Supreme Court said today that city councils and other public boards are free to open their meetings with an explicitly Christian prayer. Judges may not act as "censors of religious speech" simply because the prayers reflect the views of the dominant faith, they said.

That means, of course, that if there comes a day when Islam or Hinduism or any religion other than Christianity happens to become the dominant faith in our country, or if an adherent of a religion other than Christianity offers the opening prayer at a city council meeting tomorrow, prayers to Allah or Vishnu or perhaps an Earth Goddess are fully protected. I’m ok with that. But how will the Christians who were the defendants in today’s case respond when that happens? Will they rejoice, as they have today? Or will they fiercely object, claiming their first amendment right not to be subjected to another’s faith in a government context has been violated?" (I withheld name of priest)

Leave it to you to not understand what is going on.

These churches are SUING the city to overturn the LGBT equality ordinance. They tried to bring it to a petition drive, and failed to get the correct number of signatures. Now they are still mad, and suign the city to get on the ballot anyways. This is part of normal legal discovery - you ask for all documents from the people that are suing you.

Neither the mayor nor City Attorney David Feldman were aware the subpoenas had been issued until yesterday.  Both agree the original documents were overly broad.  The city will move to narrow the scope during an upcoming court hearing.  Feldman says the focus should be only on communications related to the HERO petition process. However, as of the writing of this column, the subpoenas have not been rescinded.
Alliance Defending Freedom attorney Christina Holcomb said there is no evidence to suggest the city is “backing off” or “narrowing” its subpoena request.“The shame that the city of Houston has brought upon itself is real, but the claim that it has changed course is not,” she said. “The city has so far taken no concrete action to withdraw the subpoenas. Furthermore, the subpoenas themselves are the problem – not just their request for pastors’ sermons. The city is not off the hook from its illegitimate request for e-mails, text messages, and other communications in which these pastors, who are not even party to this lawsuit, may have disagreed with the mayor. The way to fix this is to withdraw the subpoenas entirely.
