Don't you need an amendment to be passed by the HoR an Senate before it goes to the states? And didn't republican as well as democrat controlled states ratify it? Didn't republicans campaign on continuing the failed policy?

No, it was a socialist program when it was enacted in 08'. The only people who supported it were donks and RINOS.

34 RINO Senators voted for it. 15 mostly conservative senators voted against it.
39 Donk Senators voted for it. 9 voted against
2 Independent's split, with Lieberman for and Sanders against.
