I don't think GZ is "guilty" legally, but it's really hard for me to swallow a guy walking away completely after fvcking with an unarmed kid and later killing him.
Re: Zimmerman Trial
You MUST be mistaken. That would be reversible error and every first year law student would know that.CID1990 wrote:I saw that part with the judge questioning Zim about whether he would testify, and yes believe it or not it was with the jury present.
The court may ask a defendant if he intends to testify but the court absolutely cannot do it in front of the jury.
Re: Zimmerman Trial
I just searched around the net. I couldn't figure out whether this happened in front of the jury.
However, I couldn't believe what I saw on the video. The court swore him in? And then questioned him? And this was done long before the defense was ready to rest?
Just wow.

Re: Zimmerman Trial
Bottom line, to me, is that there is obviously reasonable doubt about the prosecution assertion that he did NOT act in self defense. I don't see how anybody can possibly say otherwise.
Then the judge gave the jury the option of convicting him of manslaughter. Psychologically, that's going to make them think they can "compromise." But there is no way this guy is guilty "beyond a reasonable doubt" because there is not way to say it's not within the reasonable realm of possibility that he thought he was in danger of death or great bodily harm.
This is a completely political prosecution. And it'll be a completely political manslaughter conviction.
I do think the defense erred in giving a long closing statement. I think they could have quickly and concisely focused on "reasonable doubt" with respect to each major point the prosecution attempted to make. I think they could've been done in about 10 or 15 minutes. The prosecution's case, as far as I can tell, is entirely speculation. And that could've been demonstrated, I think, in very short order. I think they could've started off by saying something like, "This won't take very long because it doesn't need to take very long" and gone on from there.

It wasn't in front of the jury but shouldn't she have waited until the defense rested? And is that grounds for appeal if there is a conviction?JoltinJoe wrote:I just searched around the net. I couldn't figure out whether this happened in front of the jury.

The prosecution didn't spend enough time on the changes in Zimm's story and how the things that he changed his story on are things that would have pointed towards premeditation. He's a vigilante who shot an unarmed juvenile.

There were a number of you who were wrong on this...CID1990 wrote:In Florida a judge can instruct a jury that they can consider a lesser charge.
At this moment, given all the information available right now, I think this is precisely what will happen. Zimmerman will be found not guilty of 2nd degree but guilty of manslaughter. He will get that max sentence of 20-30. The sentence will be completely political. I say this because I used to deal daily with guys who have murdered other guys just like them. These guys walk free because 1) nobody saw nuttin, and 2) the victim is also black. If Zimmerman was black this would just be another forgotten story about how the most dangerous thing to a black man in America is another black man between the ages of 15-32.

Re: Zimmerman Trial
Not sure why so many of you thought that...JohnStOnge wrote:The thing is that, based on what I've seen through an admittedly distorted prism. I don't see how anybody can say there' isn't reasonable doubt. If there's a reasonable possibility that Zimmerman thought he was in danger of great bodily harm then self defense comes into play and there's reasonable doubt that a crime was committed. They have an eye witness saying Martin was on top of Zimmerman moving his arms downward. They have the pictures of damage to the back of Zimmerman's head and know he had a broken nose. They have the forensic guy saying the gunshot information is consistent with Martin being on top of Zimmerman.
The prosecution was asking how Zimmerman could've gotten to the gun and shot if Martin was on top of him but there's testimony by a Martial Arts expert saying he could've done it. Plus how can you be using that to argue that Martin wasn't on top when there's an eye witness that saw him on top?
This is just ridiculous. Zimmerman is not supposed to have to prove beyond a reasonable doubt that he thought he was in danger of bodily harm. The prosecution is supposed to have to prove beyond a reasonable doubt that he did not believe that and shot Martin anyway.
I think he'd going to end up being convicted of Manslaughter because that option has been made available and the jury will think it can split the baby. And that's going to be a travesty unless the media distortion is REALLY bad as to what's been presented. No way the prosecution showed beyond a reasonable doubt that he did not think he was in danger of serious bodily harm.
I would have been mildly surprised to see him get convicted of manslaughter, who's sentence in this case would have been almost as bad as 2nd degree.
