I am saying that a blanket grab of AP phone records without a warrant is not within the permissions regime of USAPatriot.
It isn't my fault if you can't figure it out. Suggest you go read the USAPatriot codes and see where it provides for grabbing bulk media phone records, even under national security terms, as is being claimed right now. There are already laws governing what was done, and those laws were broken. Holder himself has confirmed this.

It's simple...houndawg wrote:kalm wrote:

I'm still trying to figure out what "..the AP scandal was not/not USAPatriot compliant." means.
There are only 3 ways you can obtain confidential phone records:
1. Good old fashioned subpoena where the prosecuting attorney has to show probably cause.
2. A Grand Jury can subpoena phone records in which the US Attorney has to notify the person being targeted (they didn't).
3. An agent to agent request (with regards to the Patriot Act) where one agent gives another agent a search warrant to obtain phone records. BUT that is only in cases of "national security" in dealing with an imminent threat by a terrorist or terrorist organization. The AP might be a mouthpiece of the Obama regime, but they aren't a terrorist organization...thus not compliant with the Patriot Act.
Holder should be hung from the nearest tree.

That's more readable than govt. jargon like ".. not/not USAPatriot compliant." Why the extra "not"?

You're misconstruing a bit too - I get that Holder is a POS all on his own and that he has plenty of company in the administration- when I refer back to Bush it is to point out that these things that get created and implemented in moments of panic as a response just to look like you're doing something can really come back and bite you in the ass when the other guys take power. Obama is wrong all on his own for continuing the war on civil liberties -but that war on civil liberties was made a whole lot easier for Obama, and every future President, by the Bush admins babies like the DHS and the so-called Patriot Act.ASUMountaineer wrote:Agreed. That aside, the Patriot Act is immaterial to the AP scandal. I'm not defending USAPatriot, just saying that what was done in the DoJ/AP thing was not under the auspices of the Patriot Act. DHS also has nothing to do with this. Are you confusing the DoJ (Holder) with DHS (Big Sis)?

I get it when you say it like that, and yes I'm probably confusing the two. When you say "..not/not compliant with.." it reads like two negatives make a positve, to me anyway.CID1990 wrote:I am not entirely sure Obama himself is giving the orders to do things like this.houndawg wrote:

I don't care if Obama giving orders or not, he hasn't done anything to change the fact that you can be held incommunicado, without due process, for more than a decade because somebody said you were a terrorist. I expected Bush and his goons to wipe their asses with the Constitution, I expected better from Obama.
