I actually met Judge Bork once and have read all of his books. You can disagree with his "originalist" philosophy if you like, but the man had more smarts than Breyer, Ginsburg, Sotomayor and Kagan put together. R.I.P. Ted Kennedy deserves to roast in hell for what he said about Bork. But he's probably there already... :coffee:

People try to be overly simplistic when classifying a person, especially on message boards. Cappy is a great example of that tendency.

Like Ivy said, disagreeing with a judicial philosophy is one thing, but Bork was far more complicated than the out and out libel that Kennedy categorized him as (and lemmings like Cappy just lap up). I disagree a lot with his judicial outlook, and the dude was one scary man (seriously, why didn't they have him shave before nominating him, he looked like the unibomber when those hearings took place), and frankly, I'm glad he wasn't a justice, but to say that he's resting in Hell, when you don't even believe in Hell, just based upon disliking his judicial opinion is small minded to say the least. I mean, the guy agreed with Brown vs Board of Ed and even advocated that the NRA had it wrong on gun control (meaning he'd be supported by many today in that regard). Hardly the stuff of a circle of Hell-type person.

Robert Bork was toast after Ted Kennedy said: "Robert Bork's America is a land in which women would be forced into back-alley abortions, blacks would sit at segregated lunch counters, rogue police could break down citizens' doors in midnight raids, schoolchildren could not be taught about evolution, writers and artists could be censored at the whim of the Government, and the doors of the Federal courts would be shut on the fingers of millions of citizens for whom the judiciary is—and is often the only—protector of the individual rights that are the heart of our democracy."

Ted Kennedy lied. As was stated in Kennedy's obituary in The Economist:

“There was not a line in that speech that was accurate,” wailed Judge Bork afterwards. He was right. But it worked.

He told the truth about the bogus and judge-manufactured "right to privacy" -- that it was an illicit tool in the hand of the judiciary to interfere with the moral choices made by the people at the ballot box.

I believe that we can trace the roots of modern-day partisanship to the Bork nomination hearing and its immediate aftermath...

There had always been partisan snipping but it jumped exponentially following the nomination hearings...and we are where we are today...

I think there's a fair amount of truth in this - never before had such personal smears worked so well as they did with the smearing of Bork. It wasn't just a difference in judicial philosophy as much as it was a very personal and vindictive attack. I think both sides of the political aisle saw that and decided to lean more in that direction going forward. You could argue that it was politics following the culture or culture following the politics, but I do think you're right in that even the normal partisanship that we've always had got ratcheted up following that event and still continue today, to our detriment.

I agree that the left is a little weak on thought leaders that the right respect. On the right, I think a lot of Liberals disagree with but respect George Will. Molly Ivins filled that roll for me but she's gone now. At the Chicago Tribune, Eric Zorn is a pretty good liberal columnist. He's pretty far left but he's also open-minded and not blindly devoted to his cause. He points out the warts on his own side just not as fervently as the warts on the other side.

I think this is true. But the right's bubble is far thicker. By nature, part of the definition of a liberal is to question everything while part of the definition of a conservative is to believe in the status quo.

I think you're falling for stereotypes of each side when it's more complicated than that. There is more to conservatism than just pining for the old days and maintaining the status quo. Conservative shouldn't be that narrowly defined - you have social conservatives, fiscal conservatives, chronological conservatives, etc. I'm a fiscal conservative but I don't pine for the good ole days.

I try to be open-minded and question and I've had a hard time finding liberal columnists that I respect. The whole Hostess/Union thing is a good example, the liberal columnists I've read fall lockstep in line with blaming management and conservative columnists are lockstep in blaming the unions when the reality is that management and the unions are both at fault for the company's failure.
