Harvard Prof. Alan Dershowitz: Zimmerman Arrest Affidavit ‘Irresponsible And Unethical’

Harvard University law professor Alan Dershowitz appeared on MSNBC’s Hardball where fill-in host Michel Smerconish asked him his opinions of the arrest warrant issued and carried out for alleged Trayvon Martin murderer, George Zimmerman. Dershowitz called the affidavit justifying Zimmerman’s arrest “not only thin, it’s irresponsible.” He went on to criticize the decision to charge Zimmerman for second degree murder by special prosecutor Angela Cory as being politically motivated.

“You’ve seen the affidavit of probable cause. What do you make of it,” Smerconish asked. “It won’t suffice,” Dershowitz replied without hesitation.

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”
Dershowitz said that the elements that would constitute that crime are non-existent in the affidavit. “It’s not only thin, it’s irresponsible,” said Dershowitz.

Dershowitz went on to strongly criticize Cory’s decision to move forward with the case against Zimmerman. “I think what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation and overcharged. This case will not – if the evidence is no stronger than what appears in the probable cause affidavit – this case will result in an acquittal.”

Smerconish identified the total lack of any mention of the supposed fight that occurred between Martin and Zimmerman prior to Martin being shot. He said he was disappointed that he did not see any mention of that conflict that led to Martin’s murder.

“But it’s worse than that,” said Dershowitz. “It’s irresponsible and unethical in not including material that favors the defendant.”
“This affidavit does not even make it to probable cause,” Dershowitz concluded. “everything in the affidavit is completely consistent with a defense of self-defense. Everything.”

You must have some really credible inside information that the Fla. prosecutor's office isn't privy to. If they felt confident they could get a murder one conviction don't you think they would have done so?
Again, let the facts come out - you know what the media spoonfed you right now. There must be some extenuating circumstances to keep murder one off the table in spite of the public outcry.

Ah, young Padawan! Interesting that you would bring this up.

That will be one of the reasons Zimmerman is going to walk. He was trained in concealed carry and the attendant responsibilities, which means he did mot just walk up to the kid and shoot him. Forget that he was armed. If Martin turned on him because Zim was following him, and then began to beat on him, then the gun does not come into play until Zimmerman begins to fear for his health. Second, once the fight begins, Zimmerman is also at a disadvantage because he has to protect the weapon (so that it does not become Martin's weapon) while simultaneously defending himself. Once you get hand to hand with someone, that gun belongs to both parties. Zimmerman does not even have to show that he was in fesr fir his life. He merely has to show that he was in fear of losing consciousness, which would ALSO place a reasonable person in fear for his life, because at that point the gun belongs to Trayvon.

The second worst fight I was ever involved in during 17 years of law enforcement was with a 15 year old girl half my size. She had my pistol unsnapped and it was in a school, so whipping her butt was not priority number 1 at that point.

In many cases, relative size has very little to do with the outcome of a fight.

I know that he gets a full and fair trial by a jury of his peers. I believe that he was guilty of manslaughter. If he can receive a fair trial, that is the verdict I expect to see.
