Sharing responsibilty means splitting the medical bills, not rewarding the clutz with a cash settlement.Skjellyfetti wrote:Uh. She wasn't. Me too. And, I'm not saying the woman didn't have responsibility. Neither did the jury or court that ruled in her favor.BlueHen86 wrote:I expect my coffee to be hot, and I don't pour on my lap regardless of temperature. People need to take responsibility for their fuck ups. An old lady spilling her coffee on herself while operating a motor vehicle isn't McDonalds' fault.
The judgment was reduced because she shared responsibility.
I'm not saying it was all McDonald's fault. If you spill coffee on yourself... it's your fault. No doubt about it. If that coffee causes 3rd degree burns, you have to spend a week in the hospital getting skin grafts... that isn't your fault. McDonald's shared the responsibility.

If I recall right, the documentary that he's referring to stated that she originally only wanted help with the medical expenses. Mickey D's stonewalled and got sued. After all the evidence was presented, the jury awarded her one day's sales of coffee at McDonalds.BlueHen86 wrote:Sharing responsibilty means splitting the medical bills, not rewarding the clutz with a cash settlement.Skjellyfetti wrote:

The documentary is called "Hot Coffee" and is worth watching if you haven't seen it. It definitely has a bias against the tort reform laws that came about after the McDonalds suit, but it has some good information.

If what you're saying is that our judicial system is a big part of what's wrong with this country I agree with you. This is one manifestation of it. I roll my eyes everytime someone says we have the best judicial system in the world. Absolutely no basis for saying that. Our Judicial system has become an enormous parasite on one hand and exercises an unconstitutional level of power on the other. We have judges who have no clue as to policy questions having the final say on what national policy is going to be. Our Judicial system is an abslolute disaster but we have this fantasy mythology about how great it is.
It sucks.

No, I'm saying people (and laywers) who ABUSE our legal system like this, and then are rewarded with actual CASH damages, are what's wrong with this country. I'm not willing to throw the baby out with the bathwater...the issue is the lack of morals that is rapidly taking hold of this country, and people's "get while the gettin' is good" mentality of more and more assholes in America.JohnStOnge wrote:If what you're saying is that our judicial system is a big part of what's wrong with this country I agree with you. To me, my friend, the fact that people CAN abuse the legal system like that is one symptom of the sickness of our legal system. Our legal system sucks. I'm not saying it couldn't be worse. It could. But it still sucks. No, I'm saying people (and laywers) who ABUSE our legal system like this, and then are rewarded with actual CASH damages, are what's wrong with this country. Well, I believe it's a long way from "sucking", but it certainly could be improved upon. A legal system that encourages/requires/allows stoning a woman who is raped by her brothers is a better example of a legal system that "sucks".JohnStOnge wrote:To me, my friend, the fact that people CAN abuse the legal system like that is one symptom of the sickness of our legal system.
