FLORENCE, Mont. – A bicyclist who was injured when he hit a patch of ice and crashed on a pedestrian/bike path in Florence last winter has reached an out-of-court settlement worth nearly $100,000.

The president of the Florence Park District says he's disappointed in a system that allows a man riding a motorized bicycle on a winter night on a trail that doesn't allow motorized vehicles to receive an insurance settlement. Half of the settlement came from a Florence bar because snow was pushed onto the trail when the bar parking lot was plowed.

John Cornish tells the Ravalli Republic for a story published Monday that people should know riding a bike at night in winter is a little dangerous.

A motorized bicycle?

I think it's safe to assume that if you are too lazy to ride a bike without a motor to do the pedaling for you... you would be the type to sue when you crash your motorized bicycle.

It's not expected coffee will be as hot as McDonald's mandated their company serve it... way above the temperature that your average cup of coffee is served. If served at normal temperature... the coffee would not have caused such severe burns on the elderly lady from the famous case. McDonald's had hundreds of complaints and claims about the ridiculously hot coffee... but, did nothing about it. It wasn't as simple a case as "oops, I spilt coffee on myself. I will sue now." McDonald's was negligent in serving coffee at seriously dangerous temperatures, knowing the temperatures were dangerous, and doing nothing about it.

Your scissor analogy doesn't work unless there was something defective with the scissors... that the company that made them KNEW was defective... and did nothing about it.

Me too. And, I'm not saying the woman didn't have responsibility. Neither did the jury or court that ruled in her favor.

The judgment was reduced because she shared responsibility.

I'm not saying it was all McDonald's fault. If you spill coffee on yourself... it's your fault. No doubt about it. If that coffee causes 3rd degree burns, you have to spend a week in the hospital getting skin grafts... that isn't your fault. McDonald's shared the responsibility.

I don't know what temperature McDonalds coffee is served at now, but I got a large cup the other day and couldn't even TOUCH that shit for about 75 miles until it cooled down enough to actually start sipping. :shock: :shock:
