SCOTUS orders CA to Release 36,000 FELONS!!!

Post by Col Hogan »

Maybe we should build a wall around California...thousands and thousands of FELONS will be on the street due to a Supreme Court order... :ohno:
It is one of the largest prison release orders in the nation's history, and it sharply split the high court.

Justices upheld an order from a three-judge panel in California that called for releasing 38,000 to 46,000 prisoners. Since then, the state has transferred about 9,000 state inmates to county jails. As a result, the total prison population is now about 32,000 more than the capacity limit set by the panel.

Justice Anthony M. Kennedy, speaking for the majority, said California's prisons had "fallen short of minimum constitutional requirements" because of overcrowding. As many as 200 prisoners may live in gymnasium, he said, and as many as 54 prisoners share a single toilet.

There is one left wing city in California where the mayor recently ordered the police to not use ANY FORCE in arresting "alleged criminals"... maybe they can settle there... :dunce:

Why are you against the Constitution.

California has a simple solution. Raise the revenue to build sufficient jails. Or, look at sentencing guidelines and laws to see if maybe they are overly harsh (i.e. long jail terms for minor crimes, etc).

Sidebar: The increase in violent crime in CA since the economy went into the shitter has been VERY NOTABLE. Homicides, drive-by's, stabbings, assault with deadly weapons...all have escalated. A night doesn't go by without at least a couple of homicides in the area. One weekend about a month ago we had 9 homicides, and less than a month ago, a young mother I know had a homicide ON THE SIDEWALK across the street from her house during the night, and first learned of it when she saw the crime scene tape/van while she was "loading" the kids in the car the next morning to take them to school. As a single mother, she's asked me about keeping a gun in the house, but I'm more than a bit leery since she always has small children in the home.

Gotta say, though...I've never seen anything like this. I've had a CCW most of my life, but have rarely carried: If things continue to deteriorate out here, that may change.

Violent crime has been decreasing steadily in CA since 2006, according to the FBI. :coffee:

Looks like you won't be needing that land in Tennessee.

and where will this money come from to build more prisons? i bet a good portion of these prisoners are drug users. what a waste of tax payer dollars. prisons should be filled with rapists, sex offenders, murderers, burglars, real criminals, not somebody who stuck some crack up his nose.

It would be better to just relocate the 36,000 felons to Montana.

Agreed that we fill the prisons with people that don't belong there (or for the length of time it is there).

But, if the people of California WANT those sentences, then they need to pay for sufficient jails to house the expected population.

Perfect! Another 5-4 split with Anthony "Weathervane" Kennedy in the majority. :coffee:

And, unlike poundpup, I don't think those soon-to-be-released folks would satisfy Montana's athletic entrance requirements. Southern Illinois, OTOH, is just salivating to get them!

NOT accurate - sadly.

California VOTERS did this to themselves. this is what governance via ballot measure gets you. it's very easy to put a ballot measure up that says "more and longer jail terms!" "more funding for after-school programs!" "i don't wanna pay any taxes ever!"... what you end up with is two things... politicians who have completely abdicated any sense of leadership or responsibility, because when they do make hard choices, they are met with recalls... and state budget so completely fucked that virtually nothing will bring it back from the precipice.

A brilliant case-study in why direct democracy doesn't work at all.

I agree with this. Imagine if we just used message boards and comments sections in newspaper articles to generate policy. It'd be an unmitigated disaster. Which, oddly, isn't far from where California is. :coffee:

I don't know where this 36K figure is coming from. Our local paper says it's more like 33K.

Of course, when you're talking numbers that high, 3K probably doesn't make a great deal of difference....
