Attorney General Troy King has asked BP to cease circulating settlement agreements among south Alabamians.Alabama Attorney General Troy King said tonight that he has told representatives of BP Plc. that they should stop circulating settlement agreements among coastal Alabamians.
The agreements, King said, essentially require that people give up the right to sue in exchange for payment of up to $5,000.
King said BP's efforts were particularly strong in Bayou La Batre.
The attorney general said he is prohibited from giving legal advice to private citizens, but added that "people need to proceed with caution and understand the ramifications before signing something like that.
"They should seek appropriate counsel to make sure their rights are protected," King said.
By the end of Sunday, BP aimed to sign up 500 fishing boats in Alabama, Mississippi and Florida to deploy boom.
BP had distributed a contract to fishermen it was hiring that waived their right to sue BP and required confidentiality and other items, sparking protests in Louisiana and elsewhere.
Darren Beaudo, a spokesman for BP, said the waiver requirement had been stripped out, and that ones already signed would not be enforced.
"BP will not enforce any waivers that have been signed in connection with this activity," he wrote in an e-mail.
But King said late Sunday that he was still concerned that people would lose their right to sue by accepting settlements from BP of up to $5,000, as envisioned by the claim process BP has set up.

So let me get this straight. That is truly reprehensible. I hope BP takes a giant razorblade dildo up their asses by the time this one is all wrapped up. Say what you will about Obama, but I have no problem with him penalizing this company to his maximum ability. They need to be made an example of, unlike the kid glove treatment Exxon received for Valdez.

I'm surprised that BP actually thinks it can get away with this course of action. These are akin to "contracts of adhesion" that the law disfavors.

...there is not enough information yet about this particular Horizon incident to determine whether or not BP was negligent. The mere non-use of acoustic switches on their deep well (which only Norway and Brazil require), does not support a negligence allegation.
Since the crew manning the switchroom were some of the 11 killed, we may never know what happened. Could have been an act of terrorism or a rogue employee.
In retrospect, since the failsafe shutoffs didn't work, the logical course is to redesign them. The acoustics have not been used in the North Sea which has far worse operating conditions than the Gulf, and in the places where they are used, there has been no in-service failure requiring their deployment, though they have malfunctioned repeatedly during regular service requiring rig shutdown and valve reset: Failures that shut down operations for 2-3 days and result in ancillary equipment failures with total costs in the tens of millions.
Rather than jumping on the "hate big oil" bandwagon to assign blame for the failure, you might want to wait until the investigation is complete.
