Shocking video shows a chaotic scene on a quiet Chicago street as Border Patrol agents in tactical gear drag a 67-year-old man from his car while children in Halloween costumes look on in horror.

According to his running club, the man, who is a U.S. citizen, was returning from a team run when agents pulled him out of his vehicle, tackled him to the ground and kneeled on top of him, allegedly breaking six ribs and causing internal bleeding.

The incident unfolded Saturday in the city’s Old Irving Park neighborhood, where residents say the agents disrupted a children’s Halloween parade amid an immigration enforcement operation.

Court filings in a case brought by the Chicago Headline Club, a chapter of the Society of Professional Journalists, and reviewed by The Independent, paint a different picture. Attorneys allege that on October 25, “masked CBP agents entered the 3700 block of Kildare in Old Irving Park and ruined what should have been an ordinary Saturday morning.”

Children were preparing for a parade, neighbors were still in pajamas, with one woman outside with her hair wrapped in a towel, when agents began tackling residents, including one man “approximately 70 years old.”

Witnesses said agents acted aggressively toward neighbors who appeared nonviolent. Agents allegedly deployed tear gas as they left the scene, “without any audible warning,” and wore no identification numbers.

The plaintiffs — which include a group of protesters, faith leaders and journalists who cover demonstrations — argue that federal agents under Bovino’s command “went on a tour of Chicago neighborhoods, gassing residents in different neighborhoods each day” within the last week.

“Plainly, Defendants are not merely enforcing immigration law. Immigration enforcement does not typically require the daily use of tear gas on civilians in residential areas,” she wrote.

A federal agent blatantly violated a court order against using excessive force against journalists and protesters last Thursday by pointing a gun in a veteran’s face, saying “Bang, bang” and “You’re dead, liberal.”

The Chicago Headline Club, a nonprofit representing journalists in the Chicago area, filed a complaint in federal court after the incident, which took place in the city’s Little Village neighborhood. Local residents had gathered to observe and protest a large presence of federal agents in the area, and Border Patrol chief Gregory Bovino did not respond well or care to take the earlier court order into consideration.

According to the complaint, combat veteran Chris Gentry was “lawfully standing on the side of the road voicing his opposition as agents were driving by in their vehicles.” That’s when an agent pointed a gun at him and threatened to kill him.

Chicago court hearing to focus on allegations that immigration agents used excessive force

U.S. District Judge Sara Ellis has already ordered agents to wear badges and banned them from using certain riot-control techniques, such as tear gas, against peaceful protesters and journalists. After repeatedly chastising federal officials for not following her previous orders, she added a requirement for body cameras.

On Tuesday, Bovino appeared in court yet again for a deposition — a private interview — with lawyers from both sides. Parts of the videotaped deposition will be played in court Wednesday, according to court filings.

Attorneys may also call to the stand a pastor who was hit in the head by a container containing a chemical agent while praying outside a federal immigration facility in the west Chicago suburb of Broadview, local officials detained during protests outside the facility, and a protester who alleges she was hit by a flash-bang grenade that caused temporary hearing loss, court records show.

Bovino also testified that he has "instructed his officers to arrest protesters who make hyperbolic comments in the heat of political demonstrations," court records show.

Judge grants preliminary injunction against Bovino, federal agents over use of force: "Shocks the conscience"

"It is difficult to conceive how an injunction requiring the government to comply with the Constitution could possibly be harmful," U.S. District Judge Sara Ellis said as she explained her decision.

Ellis said she sees no need for the tactics agents are currently using, saying, "I would find the use of force shocks the conscience."

Ellis said she's found "this conduct [by federal agents] shows no sign of stopping" and didn't stop after she initially issued and expanded her temporary restraining order. She said neighbors have also indicated they intend to continue protesting immigration enforcement operations.

The injunction bars federal agents from using force against journalists. Agents may ask journalists to change their location as long as they give them a reasonable time to comply, and their new location still allows them to observe government operations.

Federal agents cannot disperse crowds unless justified by exigent circumstances as defined by DHS's use-of-force policy. They are also barred from using riot control weapons unless needed to stop harm to another person.

The use of tear gas, pepper spray or other less-lethal weapons is banned "unless such force is necessary to stop the immediate threat of physical harm to another." This includes standing or kneeling on a person's body. Ellis further ordered that two separate warnings must be issued before any of those tactics are deployed and that they must be issued at a volume at which people can reasonably hear them.

Federal agents are banned from arresting people who disobey a lawful dispersal order unless those persons have committed a crime.

She said that officials' fear of injury cannot justify the suppression of free speech, and that while law enforcement is allowed to disperse a crowd when a threat to peace and or order appears, she does not find "the defendant's version of events credible."

The injunction also more strictly enforces identification requirements for agents, ordering that all agents who are not undercover or not uniformed have two separate places on their uniform that publicly identify them and their agency. All federal agents in uniform must also wear and activate their body-worn cameras. The only time a body-worn camera is not needed is during undercover activity and while conducting surveillance when enforcement is not planned, on flights or in DHS-owned facilities.

She said videos and photographs submitted by both plaintiffs and defendants showed the government acting in contradiction to limits set by the initial temporary restraining orders, deploying tear gas, flash-bangs and pepper balls with "no warning whatsoever."

She also noted Bovino himself has deployed tear gas without warning and lied about the circumstances that led to his actions. She said in Brighton Park on Oct. 4, video shows that "Defendant Bovino obviously attacks and tackles" a person to the ground, despite saying he never used force against that person.

Ellis acknowledged that, since coming under unified command, violence has decreased, but said that doesn't mean it still doesn't have the "likelihood to exist." She also noted that federal agents have had objects thrown at them and faced protesters and opposition that hasn't been peaceful.

Addressing the incident in Brighton Park, she said that some people did throw water bottles at agents, but "this still did not warrant pepper balls without warning."

She criticized the government for how they have characterized civilian opposition to immigration enforcement, saying, "Describing rapid response networks and neighborhood moms as professional agitators [shows] just how out of touch agents are."

"A Constitution of government once changed from freedom can never be restored," Ellis said, quoting John Adams, before reading the specifics of her injunction, "Liberty once lost will be lost forever."

The case is also far from over, as Ellis mentioned "Defendant Bovino admitted that he lied. He admitted that he lied that a rock hit him before he deployed tear gas in Little Village."

We Found That More Than 170 U.S. Citizens Have Been Held by Immigration Agents. They’ve Been Kicked, Dragged and Detained for Days.

Reporting Highlights

• Americans Detained: The government doesn’t track how many citizens are held by immigration agents. We found more than 170 cases this year where citizens were detained at raids and protests.
• Held Incommunicado: More than 20 citizens have reported being held for over a day without being able to call their loved ones or a lawyer. In some cases their families couldn’t find them.
• Cases Wilted: Agents have arrested about 130 Americans, including a dozen elected officials, for allegedly interfering with or assaulting officers, yet those cases were often dropped.

When the Supreme Court recently allowed immigration agents in the Los Angeles area to take race into consideration during sweeps, Justice Brett Kavanaugh said that citizens shouldn’t be concerned.

“If the officers learn that the individual they stopped is a U.S. citizen or otherwise lawfully in the United States,” Kavanaugh wrote, “they promptly let the individual go.”

But that is far from the reality many citizens have experienced. Americans have been dragged, tackled, beaten, tased and shot by immigration agents. They’ve had their necks kneeled on. They’ve been held outside in the rain while in their underwear. At least three citizens were pregnant when agents detained them. One of those women had already had the door of her home blown off while Department of Homeland Security Secretary Kristi Noem watched.

About two dozen Americans have said they were held for more than a day without being able to phone lawyers or loved ones.

Videos of U.S. citizens being mistreated by immigration agents have filled social media feeds, but there is little clarity on the overall picture. The government does not track how often immigration agents hold Americans.

Judge slams ICE for ‘fictional’ case seeking to jail migrant for 20 years. The agent involved cut himself breaking the Honduran man’s car window

In his ruling, Judge Rodriguez called the government’s description of the stop “largely fictional,” pointing to a variety of issues with the stop: agents lacked a warrant; there was no evidence the Honduran had an order of removal from the country; and officers only asked about his immigration status after they forcibly removed him from the truck and handcuffed him.

Officers claimed the 35-year-old was a threat to them, but the judge found that the evidence did not show the man trying to “assault, resist, oppose, impede, intimidate, or interfere with the officers.”

Instead, Carl, the immigration agent, appears to shatter the window out of impatience, according to the body camera footage.

“I’m going to go get my window break; I ain’t got time for this,” he can be heard saying on the footage, shortly after ordering Quintanilla-Chavez to open the door of the truck.

In dismissing the case, Judge Rodriguez criticized immigration agents’ apparent “break car windows first and ask questions later policy.”

He wrote that letting the indictment stand would “would grant immigration enforcement officers carte blanche to evade the requirements of the Fourth Amendment,” which bars the government from conducting unreasonable search and seizures.

“Silly” is putting it mildly. Nearly deporting a woman with more right to be in this country than most is a product of the racial profiling inherent in President Trump’s immigration crackdown. ICE has previously stated that “ethnicity can be a factor supporting reasonable suspicion in appropriate circumstances,” and that “officers might reasonably rely on the fact that someone exclusively speaks Spanish to support reasonable suspicion that the person is here illegally.”

Back in January, during Trump’s first week in office, the Navajo Nation announced that ICE had harassed at least 15 Indigenous Americans at their homes and workplaces simply because they looked Latino. That strategy (and the cruel processes it produces) has only persisted since.

Catholic Bishops Take Rare Step to Slam Trump’s Deportations

The bishops issued a special message on immigration from the Plenary Assembly in Baltimore, where they advocated for “meaningful reform of our nation’s immigration laws.”
