What remains amazing to me is how nobody bothers to read the law on acquisition of citizenship. If you are born to a USC and your USC parent meets the criteria for transmitting their citizenship to you, then you are natural born.

Both Cruz and Obama's mothers met the criteria to transmit.

That's citizenship.

The Constitution uses a different phrase: 'natural born citizen' as a requirement for president.

Noone is disputing whether Cruz or Obama is a citizen. It's about whether they are 'natural born' citizens.

What 'natural born' means is not at all clear Constitutionally. And, these arguments will continue to come up until SCOTUS defines it.

Cruz, McCain, and Obama should all be eligible to run for president. But, the Constitution dosnt say simply 'citizen'... it says 'natural born citizen.'

They are both natural born citizens as spelled out as the requirement for the Presidency.

BTW the trope that it is unclear is a fallacy

There are two kinds of natural born citizens- jus soli and jus sanguinus

SCOTUS doesn't have to rule on something just because there are 200 million apes who dont understand it

If you're JSO, you would look at what they understood "natural born citizen" to mean and you would have to understand the logic behind including that, namely we don't want foreigners running our country.

To become a citizen at birth, you must:

A) Have been born in the United States or certain territories or outlying possessions of the United States, and subject to the jurisdiction of the United States; OR

b) had a parent or parents who were citizens at the time of your birth (if you were born abroad) and meet other requirements

In Cruz's case the "other requirements" would be
One parent is a U.S. citizen at the time of birth and the birthdate is on or after November 14, 1986

AND

The U.S. citizen parent had been physically present in the U.S. or its territories for a period of at least five years at some time in his or her life prior to the birth, of which at least two years were after his or her 14th birthday.

If the U.S. citizen parent spent time abroad in any of the following three capacities, this can also be counted towards the physical presence requirement:

Serving honorably in the U.S. armed forces;
Employed with the U.S. government; or
Employed with certain international organizations.
Additionally, time spent abroad by the U.S. citizen parent while the U.S. citizen parent was the unmarried son or daughter and a member of the household of a person who meets any of the three conditions listed above can also be counted.

While I believe Cruz is eligible to run, the question about whether his mom was still a US Citizen is interesting, given that she voted in Canadian Elections.

Where'd the framers get that phrase, natural born citizen? Logically, it would come from a law that they were already familiar with, British common law. If you're going by their intent, I would say you have to understand the Brit's point of view.
