Bernie won't bring up the servers and email controversy, and I highly doubt at this stage of the game the FBI is going to indict an obvious favorite in the democratic race. If they were going to do something it would have happened by now IMO. She said nothing was classified - as of this article 1,300 of the emails released so far have been deemed classified.

Comey was willing to do it if Dubya circumvented the law, I would have to believe he has the same convictions if Obama's DOJ fails to bring charges.
