This is nothing new for me, BTW, I was writing editorials about the inordinate power allowed Federal Judges in the McNeese Contraband (school newspaper) roughly 35 years ago. Writing about how they were totally out of control, how they made no pretense of actually sticking to the Law and the Constitution, how they essentially constitute an oligarchy.

Amazing to me that people who ostensibly believe in the right of people to representative government and accountable government tolerate what the institution of the Judiciary has become and have tolerated it for a long time.

To me the situation is summed up by this famous Justice Charles Evans Hughes quote:

We are under a Constitution, but the Constitution is what the judges say it is.

That is a totally intolerable situation. It is the tail wagging the dog. Bass akwards. The Constitution should determine what the Judges say rather than the Judges determining what the Constitution says. And that's not what we have.

Question for the legal eagles here. What does the ruling mean to NC's recently passed law that allows Clerks to deny issuing marriage licenses based on religious beliefs? They have to refrain from all marriages for at least 6 months as it stands.

I find it comical that these "Christians" will claim to follow Gods law (well, the ones they care about) but are 3x divorced and then will fail to uphold Gods law by failing to uphold an Oath that they have sworn to uphold. If you don't want to issue marriage licenses, b/c it conflicts with your faith, then get a new job. An elected official, failing to do her duty, has to be recalled/removed from office.

Agreed, she should enforce the law or resign/be removed from office. Speaking of which, what about the Federal officials that refuse to enforce the Immigration Laws? Or misuse the IRS for political purposes, etc?
