Same-Sex Marriages in NJ to begin Monday!!!

If you don't think it should be the courts... who should decide what is and what isn't Constitutional?

The legislative branch? That would be a **** of epic proportions.

The executive branch? Talk about monarchy...

There is no perfect solution. But, yes, going to the legislative branch as the final authority on what law and Constitution require would be the best option. Government is supposed to be by the People and the Judicial Branch is farthest from accountability to the People.

What would be nice is if the Judicial Branch restrained itself and remained faithful to its role. You know, make an honest effort to divine original understanding and not interject its own view of what is best. But that hasn't been happening.

The Judicial Branches of both Federal and State governments have been out of control for a long time. I guess when you stick a black robe on somebody and require that everybody stand up when they walk in goes to people's heads too frequently.

But it's not their job to make policy. It's just not.

Just because someone does not believe in gay marriage and supports it does not mean they are a bigot.

Because marriage is between a man and a woman. Have your so called 'civil union' and get all the government perks that go along with that but do not tell me that I am a bigot because I do not embrace your lifestyle.

Have your gay pride parade, fly your rainbow flag and do whatever you want to in your life but do not tell me how to think or what you think should be my thought process.

Being against Judicial fiat is VERY Libertarian. Judges are not supposed to be determining the direction of the society. They're stepping out of their role when they do that. Their job is, or at least it should be, to ask themselves whether or not the people that passed a certain law or ratified certain language to a Constitution understood what they were doing to require or prohibit a certain thing. They are not supposed to exercise their own opinion as to what is best or "just" at all. They are not supposed to impose any will at all. They are not supposed to worry about what they think is best.

But they are not like that. They are completely out of control.

What if a church decides to allow gay marriages in a state where they are outlawed?
