It's simple...

There are only 3 ways you can obtain confidential phone records:

1. Good old fashioned subpoena where the prosecuting attorney has to show probably cause.
2. A Grand Jury can subpoena phone records in which the US Attorney has to notify the person being targeted (they didn't).
3. An agent to agent request (with regards to the Patriot Act) where one agent gives another agent a search warrant to obtain phone records. BUT that is only in cases of "national security" in dealing with an imminent threat by a terrorist or terrorist organization. The AP might be a mouthpiece of the Obama regime, but they aren't a terrorist organization...thus not compliant with the Patriot Act.

They shouldn't be singled out for being right leaning...and that's truly the problem here. I would expect the same scrutiny of the occupy movement...if they actually had a physical address and didn't live in tents on public spaces...the filthy hippies.

I get it when you say it like that, and yes I'm probably confusing the two. When you say "..not/not compliant with.." it reads like two negatives make a positve, to me anyway.

I don't care if Obama giving orders or not, he hasn't done anything to change the fact that you can be held incommunicado, without due process, for more than a decade because somebody said you were a terrorist. I expected Bush and his goons to wipe their asses with the Constitution, I expected better from Obama.
