People can do whatever they want in their free time. But if what they're doing isn't "protected", I'm under no obligation to hire them.
I know for a fact some of my employees smoke weed. They've told me. They also drink. I don't care what they do on their free time.
What I DO care about is what they do on my dime. And as such all of my employees sign an agreement upon employment that I can drug test them at anytime if I suspect they are under the influence while at work. After work and not driving one of my vehicles? Do whatever the hell you want (although my insurance company won't cover anyone I hire who has a DUI, so driving drunk is probably not in their best interest either).
