I think this will likely see the courts - I don't think a potential employer has to give you a reason for why you weren't hired, but the results of a random screen leading to dismissal would certainly have to be disclosed to the employee. What if a guy smoked 40 days ago and has a trace amount in his system? I guess employers can have a zero tolerance policy....it could get complicated.

Boeing has stated its drug policy is unchanged (PERIOD)
Nintendo has stated it will defer to whatever local laws list as illegal - so no pot testing - but other drugs will be enforced
I'll check with my girlfriend on the Microsoft policy
Although I've never heard of them ever doing any drug testing
