North Dakota House says UND must keep Fighting Sioux name

BISMARCK, N.D. — Setting up a potential clash with the NCAA, the North Dakota House on Monday approved a bill that requires the University of North Dakota to keep its Fighting Sioux nickname.

The university has been preparing to drop the nickname and an American Indian head logo this summer as part of a negotiated lawsuit settlement with the NCAA, which considers both to be hostile and abusive to American Indians.

House members voted 65-28 to approve legislation Monday that requires UND to keep the nickname and logo, and directs Attorney General Wayne Stenehjem to consider an antitrust lawsuit against the NCAA if any penalties result from keeping them.

The bill now goes to the North Dakota Senate for its review. NCAA spokesmen did not immediately respond to telephone and e-mail messages left on Monday.

Supporters of the measure argued that the Board of Higher Education, in deciding to discard the nickname and logo, ignored strong public sentiment in favor of both.

"Overwhelmingly, Native Americans and regular North Dakota citizens ... they said, we don't want the name to go away," said the bill's sponsor, Rep. Al Carlson, R-Fargo, the House majority leader. "Are we supposed to ignore it, and say, we don't have the authority to do that?"

Representatives also voted down two related bills that required UND to keep the nickname unless the members of the Standing Rock Sioux Tribe voted to revoke permission for using it.

The tribe's governing council has approved several resolutions opposing the nickname, but it has never been the subject of a reservation vote. North Dakota's other major Sioux tribe, the Spirit Lake Sioux, endorsed the nickname and logo in an April 2009 referendum.

Opponents of Carlson's proposal said it would ignore years of review of the issue by the Board of Higher Education and UND that resulted in the decision to discard the nickname and logo.
"We will have decided that after five years of work on the part of the University of North Dakota's faculty, their staff, their students ...the higher education board and the attorney general, to name some — they're all wrong. They didn't get it," said Rep. Phillip Mueller, D-Valley City.

The NCAA declared the American Indian nicknames of more than a dozen colleges, including UND, to be "hostile and abusive" in 2005.

The state sued, and the two sides settled out of court in October 2007, with UND agreeing to retire the nickname if the school could not get the consent of the Spirit Lake and Standing Rock Sioux tribes to continue using it. If UND keeps the Fighting Sioux nickname, the school may be barred from hosting NCAA postseason tournaments.

A nice easy compromise should be to call them the Sioux w/o the fighting part. Or get rid of this bullshit rule until the Washington Redskins have to change their name, which aint happening.

UND could still host a conference tourney, the NCAA's punishment only involves NCAA postseason play.

That said this bill is going nowhere, it requests our AG to submit an antitrust lawsuit against the NCAA, problem is the state of ND already had one antitrust lawsuit against the NCAA and it was dismissed with prejudice.

Which wouldn't affect the Big Sky directly, just UND. At least to my knowledge.

Isn't a conf. tourney post season? If it's not then they'd only have to worry about hockey and the the fb playoffs, the 2 most important things to UND by far. The NCAA is dumb in soooooooooo many ways

Conference tournaments don't apply, I believe UND hosted WCHA tournament games when they were on the NCAA's hostile and abusive list previously.

I'm not sure but I think all the NCAA postseason hockey games have to be played at neutral sites, the only problem for hockey is if the Big 10 league is formed and UND is blacklisted by Wisconsin and Minnesota for non conference games. Those are big games for UND and both of those schools have policies that say they wont' schedule games vs schools that are considered hostile and abusive by the NCAA.

Football is really the only team that would get the screw job immediately.

So if Wisconsin or Minnesota have to play UND in a regional, they'll forfeit right? Oh wait they'll disregard their beliefs if it means playing in a regional. Florida St. is rich so they aren't hostile, says good ole "Chief Bribe with Money "? Minnesota and Wisconsin can play them.

The North Dakota Senate voted today to approve legislation ordering UND to retain its controversial Fighting Sioux nickname and Indian-head logo.

The vote was 28-15 with four senators absent and not voting, and came after a massive e-mail lobbying campaign that senators said heavily favored approval.

The bill, passed earlier by the House on a 65-28 vote, goes now to Gov. Jack Dalrymple, who said he will sign it.

I think not being able to host post season games is worth that to be honest.

Who knows, some people think this bill is unconstitutional. I don't think anyone is happy right now because nobody knows where this is going. The legislature basically passed the bill and said I guess we'll find out what happens next.

Why the state legislature would pass something like this despite an NCAA ruling and the school on the verge of joining a new conference is beyond me. I am sure a lot of folks just want to get this behind the school and move forward. You gotta think the BSC is watching this whole situation intently, I am sure they want no part of this drama. :ohno:

UND has announced they are continuing to retire the nickname. They recognize they take their orders from the State board of higher education not the legislature. The fight for control of the university system is underway. The SBoHE has protected the universities from political meddling since the 40s. There has been a lot of friction in the past few years. This is a disaster for the state.

these people are idiots, seriously. they are still disrespectul to the native americans.
most dont understand that the Tribes are SOVERIEGN NATIONS, A) the standing rock tribe will never be forced into a vote, therefore und will never get their vote
B) even if they GOT a favorable vote from the tribes, guess what, in the next tribal elections, the new tribal council could rip up any contract at any time, ive seen it happen in business all the time.

these stupid legialtions cant stop anything, and und is screwed no matter what, the sissy senators that voted yes for it just didnt want to lose a single vote in the next election, funny as hell.

sorry, und loses all around in this thing, and its hilarious to watch.

SECTION 1. A new section to chapter 15-10 of the North Dakota Century Code is created
and enacted as follows:
University of North Dakota fighting Sioux nickname and logo.
The intercollegiate athletic teams sponsored by the university of North Dakota shall be
known as the university of North Dakota fighting Sioux. Neither the university of North Dakota
nor the state board of higher education may take any action to discontinue the use of the
fighting Sioux nickname or the fighting Sioux logo in use on January 1, 2011. Any actions taken
by the state board of higher education and the university of North Dakota before the effective
date of this Act to discontinue the use of the fighting Sioux nickname and logo are preempted by
this Act. If the national collegiate athletic association takes any action to penalize the university
of North Dakota for using the fighting Sioux nickname or logo, the attorney general shall
consider filing a federal antitrust claim against that association.

Curious. The lead sponsor is from Fargo. The others from Bismarck, Mandan, and Tioga. None from anywhere near Grand Forks.

I think you are correct.

The fact that none of the sponsers were from Grand Forks is two fold, at least in my opinion.

1) They allied with others for cover
2) Their allies have a goal of eliminating the State Board of Higher Ed. They do too. It will be easier to control the state dollars and where they go if they could eliminate the pesky SBoHE. Same people are backing a constitutional amendment to do just that.

Thats the disaster for North Dakota. its a constitutional crisis with nefarious over tones. After all the SBoHE was the result of an initative by NDSU students in the 30s when politics were working against the Mighty Land Grants and Governor Langer had pulled NDSUs accreditation for not playing ball with his initiatives. NDSU pushed back, accreditation was restored and the SBoHE was formed to take politics out of higher education.


Lakes is essentially correct by the way. It was Cap-Cat that quit the FCS. Remember he is getting Gopher season tickets. He will do well if he scalps his BISON game tickets. Prices are quit high for them right now.
