Jumping the gun here.
I know for a fact some of my employees smoke weed. They've told me. They also drink. I don't care what they do on their free time.
What I DO care about is what they do on my dime. And as such all of my employees sign an agreement upon employment that I can drug test them at anytime if I suspect they are under the influence while at work. After work and not driving one of my vehicles? Do whatever the hell you want (although my insurance company won't cover anyone I hire who has a DUI, so driving drunk is probably not in their best interest either).

State's rights issue. If its not specifically spelled out in the Constitution its supposed to be left up to the states. Every state should be able to set their own drug laws, abortion laws, gay marriage laws, labor laws & minimum wage rates, etc, etc, etc. Course with our fed govt (executive, legislative, judicial, and regulatory) intruding in areas they have no business intruding in that isn't the case.

For something he did in the last month? I thought we were presumed innocent?

It should be up to the state to prove you were driving impaired at the time.

Obviously it depends on the nature of the work. Operating heavy machinery or driving a bus is much different than the jobs I mentioned.

They have drug testing (Piss Tests) policy
The president of the company ask the HR department
if they thought I should be piss tested since I live in Washington

The HR department said: He will take a piss test - Damn right
but we won't enforce any Marijuana findings - its legal in the state and we're fine with that

Of course I peed a spotless pee (as I am 100% drug free)
