My colleague, Sarah Quinlan, just announced that West Virginia Senator Joe Manchin has declared he will vote to confirm Brett Kavanaugh to the Supreme Court.

And if they are all expected to vote the same way...what does that mean???

If they are all voting the same way, it means they are voting to confirm.

And if you think about it ... Manchin is a Democrat from a red state who needs to vote for Kavanaugh for "back home" reasons, but can't seen, in Washington, as the one casting a decisive 50th vote. So the message he delivered had to be, "I'm in if you don't leave me hanging." And so they told him, "We've got you covered."

I remember when my buddies would call me up in high school and say "hey, we got a couple cases of h-bombs and so and so's parents are gone for the weekend so a bunch of us are heading over there in an hour." When dudes get rapey with you it's totally understandable that you want to bury it deep inside and try to forget and move past it. But that buried shit might come out much later someday and even if you remember for a fact through the beer soaked haze of a teenage summer night who it was and even if that person is being considered for a position of immense power, the trail is most likely simply too cold to prove it. Going public must be a hard thing to do in that instance and it requires some serious courage...especially knowing that in the end it won't make a difference anyway.

Although I should add Scalia never said he was pro-life. He simply repeated many times that the issue of abortion, like most other important issues in a democracy, should be decided by people trying to persuade each other as to the merit of their position, and then casting votes on a state-by-state basis.

Despite what you've read, here is Scalia's position stated in a decision, in a nutshell:

"The States may, if they wish, permit abortion on demand, but the Constitution does not require them to do so. The permissibility of abortion, and the limitations upon it, are to be resolved like most important questions in our democracy: by citizens trying to persuade one another and then voting."
