89 was right, that was what I was asking.

I think this will likely see the courts - I don't think a potential employer has to give you a reason for why you weren't hired, but the results of a random screen leading to dismissal would certainly have to be disclosed to the employee. What if a guy smoked 40 days ago and has a trace amount in his system? I guess employers can have a zero tolerance policy....it could get complicated.

Right, but if you have a job operating a forklift or other heavy equipment, and you show up visibly intoxicated, there are going to be consequences.

Boeing has stated its drug policy is unchanged (PERIOD)
Nintendo has stated it will defer to whatever local laws list as illegal - so no pot testing - but other drugs will be enforced

I'll check with my girlfriend on the Microsoft policy
Although I've never heard of them ever doing any drug testing
