Conks and Donks agree: Asset Forfeiture needs overhaul

Due process has been trampled by the government on all levels when it comes to asset forfeiture. I have hundreds of my own stories about the issue from my cop days- and it is one of the main reasons I never went to narcotics.
This is the bad side of the "War on <insert latest portent of doom here>. It allows the bureaucracy to take the reins with little to no oversight, and little ability to sue the government for redress.
Make agencies prove that assets are ill gotten in front of a judge, and you'll see organizations like the FOP and the IACP declaring the war on drugs as lost within 5 years.

Agreed CID - the laws are abused and are a money grab for departments and government.

Yep. Business as usual. I don't see anything for anybody to debate. 60 Minutes exposed the I-10 shakedown by the cops in Louisiana about 20 years ago with dummy cars and hidden cameras. Agreed and to me it doesn't even matter if one says they're abused or not. There is NO way government should be able to take your assets without first having proven their case in court. And I'm not so sure about freezing them either. To me it's pretty bad to have a situation in which government can charge you with a crime then freeze your assets so that you can't utilize them to defend yourself.

The same notion applies to the 4th amendment. Government is required to jump through hoops according to the constitution. If you support domestic spying you do not support the constitution.

Agreed. There is WAY too much of a "as long as they keep us SAFE" attitude among the population right now. This country is not really supposed to be one in which the primary concern is safety and I think the population has lost sight of that.The same notion applies to the 4th amendment.
