Yet when I contacted this company, they sent me exactly, and I mean exactly, the same reassurances about objectivity, integrity, and independence that they themselves had laughed at as "mere puffery," "vague," and "so generalized that a reasonable investor would not depend" on them.
Then they went on to deride the plaintiffs in their lawsuit for not being smart enough to do their own research and make their own assessments about the meaning of an S&P rating, and the value of its reassurances of independence and integrity. Yet us reporters are apparently still expected to take such assurances at face value, which if my math is correct means that in their eyes, we must be even dumber than the investors in the products they rate. What a bunch of assholes!

You know if I'm reading/hearing correctly the guy got those e mails and such from lawyers who tried to use them in a lawsuit and those lawyers lost. When the whole ball of evidence wax was tested in court it wasn't sufficient to hold the companies liable for anything. And we're talking about a situation in which the standard of proof is "a preponderance of the evidence." That's basically sufficient evidence to slightly incline reasonable minds to believe one side over the other.
Those lawyers couldn't even get that.
I'll admit I'm not a big fan of the Court system but part of it is that I think that our system allows a bunch of plaintiffs to recover when they shouldn't. I don't think we have a big problem in this Country with people who should've been held liable not being held liable.
Anyway you need to think about that. All the evidence this guy is talking about is part of a larger body of evidence that was not sufficient to develop a preponderance of the evidence that wrongdoing occurred. Something tells me he's not giving the whole story in balanced perspective. Just a guess.
