the Constitution, which states, “When the President of the United States is tried the Chief Justice shall preside.”

But the Constitution does not specify who would preside over the trial of a former president, nor does it even envision such a circumstance.

Thanks. I heard this explanation last night. Trump isn't President anymore (only in title).

This is where the Trump Republicans are going to go against a strict interpretation of the Constitution. :coffee:

Rand Paul forced a vote last night on whether or not the Senate should proceed with the impeachment. Only 5 Republican senators voted yes. So Trump is not going to be convicted. Quit wasting time and get to work on real issues.

The rally was obviously as spontaneous as deciding to throw the old zip ties in the pocket on your way out the door. That’s probably why Tuberville and Brooks are denying attending the meeting.
The night before the deadly attack on the U.S. Capitol, Alabama Republican Senator Tommy Tuberville and the then-director of the Republican Attorneys General Association met with then-President Donald Trump’s sons and close advisers, according to a social media post by a Nebraska Republican who at the time was a Trump administration appointee.

Charles W. Herbster, who was then the national chairman of the Agriculture and Rural Advisory Committee in Trump’s administration, in a Facebook post at 8:33 p.m. on Jan. 5 said that he was standing “in the private residence of the President at Trump International with the following patriots who are joining me in a battle for justice and truth.”

Tuberville, through a spokeswoman Tuesday, told APR that he did not attend a Jan. 5 meeting at the Trump International Hotel in Washington.

Among the attendees, according to Herbster’s post, were Tuberville, former RAGA director Adam Piper, Donald Trump Jr., Eric Trump, Trump’s former National Security Advisor Michael Flynn, adviser Peter Navarro, Trump’s 2016 campaign manager Corey Lewandowski and 2016 deputy campaign manager David Bossie.

RAGA’s dark-money fundraising arm, the Rule of Law Defense Fund, led by Alabama Attorney General Steve Marshall, paid for robocalls directing people to the March to Save America and rally, which took place just before the Capitol attack.

Herbster attended the Jan. 6 rally, but said he left before the riot, according to the Omaha World-Herald. The newspaper also reported that Herbster “also met Tuesday in Trump’s private residence in his Washington, D.C., hotel with Trump’s sons, Donald Jr. and Eric, and other campaign advisers.”

“They discussed how to pressure more members of Congress to object to the Electoral College results that made Joe Biden the winner,” The Omaha World-Herald reported.

I think I would still rather have that. I get the outrage and the desire to punish Trump. And I think impeachment has done that. However, I don't see much benefit in pursuing this into the Senate. There aren't enough votes there to convict, so it will be called an acquittal. Trump is going to wave that acquittal around as vindication that this was always just about politics and his followers will eat that up. Rather than letting Trump slink away and stew in Mar-Lago, now we'll have two weeks of Trump Senate trial drama that will only result in his favor. If they were really interested in convicting him and pulling back that pension and anything else, they would've given the Senate the impeachment papers the moment they were signed in the House. Sure, McConnell would've slowed walked it, but then it would be on him that it didn't happen. Now it does just look like political theater and it undercuts the seriousness of the riot that led to this in the first place. And we get two weeks of Congress sitting on their hands, going through a terribly dull impeachment trial (and these things, from Trump's first to the Clinton one, are unbelievably boring), while we have no significant legislation regarding COVID, vaccinations, etc. I'm sure someone will keep a tally of how many people die from COVID during the two weeks that Congress gets nothing done while tied up with this political drama. Apparently we can change parties but still have a leadership void. Not surprising unfortunately.

2012 - Benghazi - Crucify Obama for failing to respond quick enough!
2021 - US Capital - It's ok that Trump didn't respond quick enough.

You might be right, I do think they're wasting their time and as Ganny argued, keeping Trump in the news. I am a skeptic though and prefer that Congress waste its time on impeachment rather than fvcking things up by passing bad bills. Gridlock is good!

I think you're right. There are things that the Founders didn't intend...like giving blacks freedom and women the right to vote. So, we have to adapt to the situations we're in.


I do think an impeachment AFTER a POTUS leaves office is a dangerous precedent and is ridiculous. If there's good evidence to hold Trump liable for the insurrection, bring up charges.

But I imagine it'll turn out like the 10 congressional investigations into Benghazi - nothing.

He has a D next to his name so he's safe until we have a shift in power. If and when they retake power, I think the Republicans will focus on impeaching Democrats like FDR and LBJ.

He was impeached as a sitting President. The Senate conducts a trial and that's what they're doing.

The Constitution doesn't say the trial has to be done before he leaves office. Otherwise, a President could abuse his office in any way he chooses in the last few weeks of his Presidency. You argument is that is as the founders intended? :suspicious:
