I'm certainly not taking up for a bunch of possible rapists, but answer me this....if these charges were brought to the Watauga County Sherriff's department, the DA did not pursue because of "lack of evidence", how can the ASU conduct board find evidence the Sherriff can't? Seems like these guys should be going through the court system if they are truly guilty with a jury to determine whether there is enough evidence to convict.
According to the ASU Code of Student Conduct, a student may request that a member of a conduct board be excluded from the conduct board hearing. “Such challenges shall be made immediately after the introduction of members of the conduct board and shall require justification,” the code states.

During the conduct board hearings, both the accused students and the persons bringing an allegation have the opportunity to cross-examine each other's witnesses, according to the code.

The code defines sex offenses as forcible or non-consensual sex acts directed against another person, including circumstances in which “the victim is incapable of giving consent, which can include but not limited to the use of alcohol and/or other drugs.”

Under the code, the standard of proof used in a conduct board hearing is “a preponderance of evidence.” “This standard is defined as the weight of the evidence that leads the conduct board to believe that the alleged misconduct is more probable to have been committed than not,” the code states. In other words, more than 50 percent of the evidence must point to a violation having occurred for a student to be found responsible.
If these guys did it then they have no business on campus and the suspensions should be upheld. We're better than this.

A similar deal happend at UOP a few years back involving the hoops teams. Apparently several members of the boys team gang-raped a member of the girls team. She ended up leaving the school. The school's conduct board ultimately decided that one player would be expelled and a few others were suspended. The expelled one ended up at another FBS school. This wasn't good enough for her, so she sued the school. Made major headlines, but ultimately went nowhere.

Schools have policies in place, and if they can show that the policies are adequate and that they were followed when an incident happens, the schools are generally fine, legally. If a link of that chain fails, though, watch out. Just hope that when everything checks out, though, you don't have a wuss in charge who caves at even the threat of a suit.

It's always the little things, seemingly innocuous, that come back to bite yah in the arse. We're heading past six months with no real resolution, (several) major screw ups from the conduct board, and still more than six months out from a 'physical evidence' report on criminal charges. No one is stepping up and saying, "This will be made right" or "I am responsible for this" or "These changes will be made to prevent X, Y and Z in the future"

The best we can get: "We still have work to do" doesn't instill tremendous faith in me.

Regardless of guilt or innocence, process and failures, it makes everyone involved look like a rube (that's being kind) and is starting to piss me off.
