NCAA sued on NCAA nickname issue--by the Sioux Tribe!!

FORT TOTTEN, ND – Speaking at the tribal headquarters of the Spirit Lake Sioux Nation, attorney Reed Soderstrom announced a lawsuit against the NCAA alleging copyright infringement and civil rights violations. The Sioux tribe supports the University of North Dakota’s “Fighting Sioux” nickname and logo, but the NCAA has deemed them to be “hostile and abusive.”
The lawsuit claims that the Sioux tribe were “indispensable parties” to a lawsuit filed by the State of North Dakota against the NCAA in 2007, the settlement of which required the state to get permission from the Spirit Lake and Standing Rock Sioux tribes, but were never included in negotiations of that settlement. It also alleges defamation, violations of the Indian Civil Rights Act, defamation and an unlawful restraint on trade.
So the group the NCAA is supposed to protect with this BS policy is now suing the NCAA for discrimination. WOW!!!

I think Doug Fullerton should just say no comment until this is all over. And UND doesn't become an offical member until July 1st. So Doug keep out its not your fight. Lets see how this lawsuit pans out, also Monday (Nov 7th) the state legislature is holding a special session and one of the issues is to repeal the state law requiring UND to stay Fighting Sioux. So hopefully that passes so UND can retire the name, and if SL wins great if not we at least have a conference.

But . . . how can this be? Lakes and JBB have repeatedly assured us that the name is paternalistic, imperialist, and racist.

This goes to show you how crazy these lawsuits are. If the people you say are offended, aren't, then shut up. I'm glad the Sioux are fighting the NCAA. It sends a strong message.

I know. How can those racists on the reservation sue the NCAA over their racist names.

Just remember Lakes (who i am sure will attack this thread) its not UND suing...its the Spirit Lake Sioux Nation. Here is their website:

No joke, I was talking to a black guy last week that said black people couldn't be racist. I pointed out the hypocrisy in his statement. I told him, "you, a black man, just said you are incapable of something. You are black, therefore you can't be something" That's prejudicial. That's racist.

Well, the answer is as plain as the nose on your face: They (Spirit Lake) only represent 1/10th of 1% of all Sioux Indians on the planet, therefore they cannot unilaterally determine whether the Fighting Sioux is an acceptable name...if we could only have gotten more indians to vote on the matter....

You know who is going to watch this lawsuit...Florida State, Central Michigan, Utah, William and Mary, and others that use NA names and or imagry..because the NCAA may decide to ban ALL NA names reguardless of permission like they first intended to until FSU threatened to sue.

I personally think it's a good thing that they are taking on the NCAA over this issue but it's going to take year(s) to get it settled. IMO. It certainly puts Doug and the Big Sky in a tough position. Does the NCAA and Big Sky enforce the original decision while this is going on ? Maybe the Big Sky presidents tell Doug to tell UND to come back when all this is finally decided ?

4. COUNT FOUR –LACK OF JURISDICTION: The NCAA lacks jurisdiction over matters of discrimination within colleges and universities. This matter clearly rests in the hands of the US Department of Education and Office of Civil Rights. The NCAA Constitution does not grant them the authority to dictate acceptable and unacceptable team names and images either.
This is one of the counts they are suing and if they win this count...The NCAA is sunk!!!!

I hate UND as much as the next Bison fan, but this is just getting sad. Just get rid of the name and move on. I for one, have always wished they would keep their name. I can't imagine them being called anything else. It's a shame that it come to this.
Here's to hoping it is resolved quickly, no matter what the result is.

No - they won't.
FSU/CMU/Utah/Illinois ALL have expressed permission from ALL relevant tribes and are compliant with the NCAA's rules... they don't have to worry about anything as their nicknames are protected. While Spirit Lake supports, Standing Rock and Turtle Mountain (IIRC) DON'T and WON'T...
Unlike a lot of Bison fans I'm not obsessed with this issue - but my years in ND have made me all to familiar with this mess - and it blows my mind that people just won't let this go...
I'm doubtful that the courts will reverse years of siding with the NCAA on these issues... given that nobody is forcing UND to stay in the NCAA (they could join the NAIA... and no, I'm not "going lakes" on this - just pointing out) if they want to keep the name... they are members of a private organization with a set of rules for membership, they know the rules and are violating them. The courts aren't going to reverse many decades of precedent with regard to private associations.

No... (and again this is IIRC country on some of this) the Tribal Councils voted them down. Their elected leaders did what they were elected to do, make decisions. What has happened since then is that outside forces have been pushing for ballot measures (the last refuge of a political scoundrel by the by) because they have polling that tells them they'd get the result they want. But here's the rub, the leaders elected weren't voted out for this decision, so it's pretty obvious that most of the people on the reservations and in that community think they have bigger issues to deal with (and believe me when I say... they do, in spades)

So...which tribes were it that voted on the measure to support the name - voted "yes" at something like a 66% rate, but the counsel members told the NCAA "No, we don't support it"

again, my memory of it was that there was no ballot held on it... it was POLLING that people were pointing to - and as a guy who has spent a lot of money over the years on polls - they can only be so reliable...

at least Standing Rock Tribe has brain cells and see right through all the $$ signs, because they know no one from grand forks gambles at prairie nights.
URSES.& Others. this is the ONLY way und can create exposure for their school, they cant win on the playing field, so they flood the media in north dakota(anti-ndsu) with stories like this everyday attempting to stay on peoples minds.
