Biden Rule doesn't apply - the GOP held the Senate, and increased their majority, from the last election. Heck, I'm sure the GOP would even point to the increase in their Senate majority as a mandate to confirm a justice if an opening happened. The Biden Rule is only a factor when the President and the Senate majority are not the same party and hence, confirmation could be considered difficult anyway, even in a regular year, let alone an election year. Biden founded that rule with GHW Bush in office and McConnell used it to great impact with Obama in office. In both cases the President was likely to have trouble getting a nominee through anyway, especially since both of those cases were before the Democrats used the nuclear option and started considering majority votes for justices.

With all that said, I hope the best for RBG, I've always liked her as a justice.

Time for Ginsburg to retire. There needs to be an age limit on all judges.

Ginsburg missing Supreme Court arguments for 1st time



WASHINGTON (AP) — The Supreme Court says Justice Ruth Bader Ginsburg is missing arguments for the first time in more than 25 years as she recuperates from cancer surgery last month.

Court spokeswoman Kathy Arberg said Monday the 85-year-old Ginsburg is continuing to recuperate and work from home after doctors removed two cancerous growths from her left lung odn Dec. 21.

Ginsburg was discharged from a New York hospital on Dec. 25.

Ginsburg had two earlier cancer surgeries in 1999 and 2009 that did not cause her to miss court sessions. She also has broken ribs on at least two occasions.

The court said doctors found the growths on Ginsburg’s lung when she was being treated for fractured ribs she suffered in a fall at her office on Nov. 7.

What's the right age? Ginsburg has health problems, but she's still been a productive member of the Court even though she's in her mid 80's now (and of the 4 living retired justices she's younger than two of them and older than the other two). As long as the judge can do the job I don't see why they can't stay on. If she was senile and no longer intellectually capable that would be a different story, but she's been the opposite of that. I don't think it's been a problem, the SCOTUS seems to generally police themselves in these matters.

I wouldn't like that. Way too much turnover, and then you start reaching deep into the judicial ranks for folks to fill the slots. In any 10 year period you would have 9 confirmations, so on average a little less than once every year. And you could have the Court lurch from one side of an issue to another within that 10 year period as you could and likely would have full turnover that would just mirror the political sways we normally see. And heck, what would happen when the Senate isn't in control of the same party as the Presidency? With 10 year terms the Senate would just wait it out - why would you ever confirm an appointee of the other political party in that kind of time frame?
