1) Is it bad that I don't care who our next president is...
2) and that I don't believe (regardless of who it is) that it'll make much difference

If nothing else, up to 4 SCOTUS Justices could die/retire in the next 5 years. Who do you want on the court - crazed ideologues like Thomas/Scalia/Alito, or thoughtful jurists like Ginsburg?

Apathy IS NEVER RIGHT. A large reason we are in the current predicament is due to apathetic/low info/single issue voters.

95% of African American voters voted for Obama primarily because of his skin color...

I wonder if you really believe that. I wonder because the truth is that Thomas/Scalia/Alito believe at least to some extent in following the Constitution while Ginsburg doesn't give a crap about the Constitution at all. She's completely outcome oriented.

I guess you could say that all of them are ideologues. But with the first three the "ideology" is the idea that the Constitution should be followed while with Ginsburg the "ideology" is that the US Constitution is deeply flawed and a judge should find excuses for not following it.

The good news for your side is that liberals can be confident that a liberal who doesn't give a crap about the Constitution will act like a liberal who doesn't give a crap about the Constitution when they are appointed to the Supreme Court. It's pretty obvious that conservatives take much more of a chance when they appoint somebody they THINK is going to be inclined to follow the Constitution. All you have to do is look at big mistakes like Earl Warren, Sandra Day O'Conner, and now Anthony Kennedy to see that.
