Man on trial for killing Drunk Driver that killed his sons

David Barajas is on trial in Brazoria County, accused of shooting and killing Jose Banda in a fit of rage.


Barajas' sons, 11 and 12 years old, were pushing their family's car after it broke down when Banda's vehicle hit and killed them.

If convicted, Barajas faces life in prison

AGREE, but...

Key term: "in a fit of rage." AKA temp insanity.

Some drunk knocks out both your kids, you go berserk and shoot him the head with your Derringer. Do you think you should have to spend the rest of your life in prison?

But if that driver were sober everybody would still be alive in this situation...



and you are more likely to be killed by a sober driver because there are no less than 150 million vehicles on the road driving every day... and only a tiny percentage are driving drunk

He'll probably do some time. In Delaware, due to the emotional distress involved, it would likely be a manslaughter rap.

A jury on Wednesday acquitted a southeast Texas man of murder in the fatal shooting of a drunken driver who had just caused an accident that killed the man's two sons.





David Barajas cried after the verdict was read and he hugged his wife, Cindy, who was also crying. He could have been sentenced to up to life in prison, if he had been convicted.
