"An undercover New York police detective at the scene of the beating of a driver by a pack of angry motorcyclists is seen on video attacking the SUV, police sources familiar with the investigation tell NBC News.

The sources, who spoke on condition of anonymity, said the video shows the undercover officer banging on the rear window and shattering it. The victim is then seen being pulled out of the car and the undercover rides off, sources say."

An off-duty undercover New York City police detective appeared in court on Wednesday to face upgraded charges of 1st degree assault and gang assault in connection with the brutal attack on SUV driver Alexian Lien on the Henry Hudson Parkway.

Undercover narcotics officer Wojciech Braszczok was arrested Tuesday night after investigators found video showing Braszczok punching the rear window of the SUV.

In court on Wednesday afternoon, prosecutors argued that he was an active participant in "terrorizing the family," breaking the rear window of Range Rover and kicking the rear passenger door where toddler was sitting. He didn't call 9-1-1 and failed to tell superiors for two days, prosecutors said.

Officials say the officer initially told investigators that he came upon the scene as the beating was ending, but sources say his story began to unravel when the NYPD acquired the new video, which has yet to be released to the public.

In related news...a 7th person has been charged, the one who allegedly was filmed using his helmet to beat the driver, and surrendered himself to authorities.

They all should do time for assaulting the guy and his family.

"Gloria Allred, a lawyer for Edwin Mieses Jr., the biker who was crushed, claims Lien bumped another motorcycle while changing lanes on the highway two to three miles before his SUV knocked into biker Christopher Cruz.

"When the video starts, we're trying to attempt to slow him down to tell him, 'Hey, there was an incident back there — we don't know if you know, or if you do know and you're trying to flee, but you just ran — you just knocked somebody over,'" Castaldo said.

Police and prosecutors say the encounter began as the tape does, with biker Christopher Cruz, 28, of Passaic, N.J., pulling in front of the black Range Rover and decelerating to the point where the vehicle bumps his back tire.

Cruz, since his arrest on reckless endangerment and other charges, has insisted he looked over at the driver only to change lanes, and didn't deliberately slow down. He didn't see any prior interaction that may have happened between the SUV and the motorcyclists, said his attorney, H. Benjamin Perez. "

Holy crap...anyone who has seen the video knows Cruz intentionally slowed down. It is indisputable. Has this clown's lawyer let him see the tape? If he uses that defense he will instantly lose all credibility. :nod:

Congress should pass a new law...if you come to court with some stupid azz excuse and waste everyone's time, you get to triple your fine and your time in jail. And the lawyer, if he doesn't start the defense with, "Excuse me your honor and ladies and gentlemen of the jury, but this is what my clients wants you to believe...," then the lawyer should be barred from practicing for 6 months.
