Another Victim in Boston

WASHINGTON -- A Justice Department official says the Boston Marathon bombing suspect will not be read his Miranda rights because the government is invoking a public safety exception.
That official and a second person briefed on the investigation says 19-year-old Dzhokhar Tsarnaev will be questioned by a special interrogation team for high-value suspects. The officials spoke on the condition of anonymity because they weren't authorized to disclose the information publicly.
The public safety exception permits law enforcement officials to engage in a limited and focused unwarned interrogation of a suspect and allows the government to introduce the statement as evidence in court. The public safety exception is triggered when police officers have an objectively reasonable need to protect the police or the public from immediate danger.

I just checked Facebook again. Curiously, none of my staunch constitutionalist friends who've made countless posts about the 2nd amendment have uttered a peep about this one. Obama...tough on terror.

And you think that's the only thing that went wrong vis-a-vis the Constitution over the past two days in this case in the Greater Boston Metropolitan area???

Eh. He still has the right to remain silent, right to an attorney, etc. etc. He just isn't verbally reminded of those rights. Not that big of a deal to me.
I think this is the first time this has been invoked? As long at it is used only in extraordinary circumstances (as it is in this case) I'm ok with it.

That's exactly what I've been thinking. Funny how all of that militarized local and state law enforcement, running around in their kevlar and cammo, were trumped by the internet sleuths on Reddit and 4chan, and it took a civilian to actually find the guy who was hiding out in his back yard.

True "staunch Constitutionalists" are opposed to Miranda vs. Arizona. It was a major stretch to begin with.

Your reaction is dependent upon the party affiliation of the president. Sure, Miranda isn't important when there is a Dem in the White House (especially Obama). If a Republican was in the White House, you'd give more than a shit about Miranda.

Interesting. I thought part of the idea behind Miranda was protect against self incrimination. Miranda doesn't prevent law enforcement from questioning right? The answers just aren't admissible in court.
