No black nurses lawsuit. According to an article posted at USA Today, a nurse filed a lawsuit against the hospital she works for after they honored a request from a father that "no black nurses" care for his baby.

The article, which was posted earlier today, says Tonya Battle filed the lawsuit after the hospital put a note on the assignment clipboard which read: "No African American nurse to take care of baby."

The veteran registered nurse was working at Hurley Medical Center in Flint in the neonatal intensive care unit on October 31, when she says the infant's father told her supervisor he that no African-American nurses were to care for his child. Battle says the supervisor passed the request on to her boss. Soon after, Battle says she was reassigned.

The hospital removed the sign, but Battle says she, and other black nurses, were barred from caring for the child for nearly a month "because of their race." Other statements in the lawsuit claim the infant's father "pulled up his sleeve and showed some type of tattoo which was believed to be a swastika of some kind."

Photo credit: Getty Images Battle says she was "shocked, offended, and in disbelief that she was so egregiously discriminated against based on her race and re-assigned," says the lawsuit, which demands punitive damages for emotional stress, mental anguish, humiliation and damages to her reputation.

Julie Gafkay, Battle's attorney, says "I don't doubt that people have made requests like this in the past. You're not going to control the prejudices and biases of people. That's not my client's issue. The problem she has … is that her employer of 25 years granted (the request)."

I mean this is 2013 not 1913

The lawsuit will probably be defeated. If you can accomodate a patiet's request for a woman doctor or a minority nurse I don't see why you can't ask that you have a white nurse for your newborn.

When I was in the hospital last year, I had to share a room with a 96 yr old WW2 vet. He was a bit loopy and constantly screamed how blacks were on the floors and they better leave before the police arrest them.

Eaxctly, I have 2 siblings and a sister in law that are all in medicine. My Brother is frequently asked to switch patients with a female nurse b/c the patient requested it. However, being that this is against a black person, i'm sure it'll get blown out of proportion.

Hospitals are put in the worst situations. It is complete BS what they have to put up with, and because of it, our healthcare costs are higher than they should be. This is just another one of those situations where the hospital has to deal with a ridiculous request from a patient and in response, some POS nurse has to sue the hospital.

I think he has a right to ask it and the hospital has a right t say that if that's his position he needs to go to another hospital that will accommodate his request if it wants to do that.

This. He has the right, as fucked up as it seems, to be as big a douche as he pleases. And the hospital has the right to tell Kim yes or no. The employee is overreacting. She didn't lose any pay, or get passed over for a promotion, etc. Grow the fuck up.

I think i'd be relieved to have a patient not want my service due to me skin color. They'd be a pain in the ass.
