An eight-year-old Newton County boy has been suspended after he brought a b-b gun to school.

Andrew Berry's mother Kristy, tells Channel 2 Action News it was an innocent mistake that he had taken to gun to his grandparents for the weekend and forgot it was in his bag, until he got to school.

"Immediately, he picked up his bag, went straight to the teacher, opened the bag and showed it to her," said Berry.

That's when the third grader at the Newton County Theme School was sent to the principal's office.

"I told him that I was at my grandpa's house, I packed it because I wanted to shoot it, and I forgot to unpack it," said Andrew.

He was suspended for ten days and has to appear in juvenile court after a police report was filed.

School Spokeswoman Sherri Davis-Viniard says the policy is clear.

"We do have the policy in place; but in fact, Georgia law states that any weapon that propels that is brought to school, we have to notify law enforcement. So the school did absolutely what they were supposed to do," said Davis-Viniard.

Andrew's grandfather Stevie Holt, thinks there should be exceptions depending on the circumstances.
