Thomas is one who I'd be worried about healthwise - he's already 70, he's been stocky, and he's African American and that already comes with a lower life expectancy. But Roberts? He's only 63 years old (22 years the junior to Ginsburg) and in pretty good health. He's even younger than Sotomayor. If there was anyone else who might go before Ginsburg I would look at Breyer - he's the only other one besides Ginsburg who was born before WWII (he's 80 years old now). I think both him and Ginsburg are likely to be waiting for a Democratic President, or at least a Democratic Senate, before they retire.

With that said, imagine the fireworks that will happen the next time a President of one party has to nominate a new justice when the Senate is held by the other party. The GOP Senate held off a few months last time for the next election, but the next time around you may see absolute gridlock and potentially a Constitutional crisis.

I’ve always liked her even though I disagree with her on many things.

I also like the version of the ACLU that she championed. They would go to court to protect civil liberties for even the most heinous people. Lately the ACLU has become a bit more illiberal. I have to think she has a problem with that.

There's a lot of truth in what you say.

In the lower courts, it's fine to have judges who are willing to work with the edges of precedent to find equitable solutions to the problem in front of them.

But if you have a Supreme Court that just makes it up as it goes along, the lower court judges will see that example and take the "law" to completely uncharted places, if need be, to create the result that they personally favor.

This is what was happening the in the 1960s through the 1980s. It is why Justice Scalia and the other originalists/textualists rebelled.
