Sky's post about school desegregation reminded me of something that did reallly bring certain things home to me. When I was in college there was a family in Rapides Parish, Louisiana, that did not want their kids bussed many miles away to school per a desegregation order. So they went to a State court and had custody of their kids transferred to a relative.

A Federal judge (Nauman Scott) held the State judge who granted the change of custody in contempt of court and nullified the State change of custody action. So the family arranged to send their kids to a parochial school. The Federal judge issued an order prohibiting the public school system from providing the kids' records to the paochial school. The parochial school ended up handling the problem by testing the kids and placing them in that way.

It didn't really change any of my philosophies. But it did really reinforce my belief that the Federal courts are out of control. To me the only word to describe what was going on with the Federal judge is "tyranny." To me there is no way an unelected Federal official should have that kind of power and also no way it's what the people who founded this country had in mind when they contemplated the Judicial branch.

State custody matters are none of the Federal government's business. Period.
