FWIW, I don't hate just JoPa over this. I think anyone involved in this cover up/knew anything and didn't do anything about it should be in prison. Once they found out and did nothing to stop it they continued to allow little kids to be raped.

One could argue there is a lot of willful blindness in this case,

Mqueary testified that he didn't go into detail about the acts with Joe Pa, so its likely Paterno DIDN'T know the kid was being raped. Just knew something inappropriate was going on.

Whats ridiculous is you've got people on here saying Joe Pa deserves the same level of punishment as Sandusky.

And where did I ever defend McQueary's actions? I don't disagree with what I bolded. But McQueary, because failing to kick Sandusky's a**, also reportedly failed to communicate the severity of the actions of what he witnessed to Joe Pa. If McQueary didn't want to let him know the details, McQueary should have gone to the police himself.

But Joe Pa didn't witness the incident, and McQueary reportedly failed to make him aware of the severity.

During the grand jury's investigation of Jerry Sandusky, it was Joe Paterno who provided the testimony that corraborated Mike McQueary's story, which is what led to the perjury and failure to report abuse charges against Penn State athletic director Tim Curley and former vice president for business and finance Gary Schultz.

But now that Paterno's dead, according to legal experts questioned by The New York Times, Paterno's prior testimony cannot be used during the trial.


Paterno's grand jury testimony is inadmissible, according to several lawyers, because he was not cross-examined in that proceeding. The Sixth Amendment's confrontation clause guarantees criminal defendants the right to confront the witnesses against them.
Wick Sollers, who was Paterno's lawyer, said in an e-mail that Paterno's statements before the grand jury constituted his only under-oath testimony in the case. With Paterno's death, the lawyers for Curley and Schultz no longer have the opportunity to challenge his credibility.

In other words, it's now McQueary's word against Curley's and Schultz's, unless prosecutors produce another witness or some additional evidence.

I'd be willing to bet you're in the same boat. Perhaps it would be best to not treat his death as if he's a diety and quietly observe his memory if you so choose. Getting on here and berating people is not going to help anyone see the error of their ways. If he knew what was going on and only reported it to his "superiors," especially about a person that--as you pointed out--was not on staff (an employee), that's just an unforgivable lapse of judgment.

Now, that's not to say that all of his good deeds throughout his life should be cast aside, but his memory should take into account the totality of his actions. It is so unfortunate that his life ended with this cloud hanging over his legacy, but only because it's even sadder what the victims had to experience.

As a human being you are obligated to take information like he got from McQuery and investigate TO THE FULLEST. No matter WHO was involved.
