Kennedy's retirement underscores the problems that are within the Democratic Party. They fumbled the 2016 Election, they keep attacking the POTUS instead of the issues and now have to live impotently in Government - that is until they retake the White House and/or Congress. Which - won't be easy. Also, they have to live with the fact that they screwed their shot at getting at least 2 justices on the bench.

Trump has secured his place in American History. He'll get at least 2 people on the bench - possibly a few more if Bader dies or Thomas retires.

That said - I do find it hypocritical of the Republicans if they confirm someone before the elections. I know the midterms aren't the same as the Presidential election, but they stalled Obama over the same thing. Obama and the Dem's should've fought harder for Garland. :twocents:

What's your point? Scalia died in February 2016. Garland was nominated in March 2016. McConnell said,
The American people may well elect a President who decides to nominate Judge Garland for Senate consideration, The next President may also nominate someone very different. Either way, our view is this: Give the people a voice in the filling of this vacancy.”

This year it's the American people who may well elect a new Congress. It's an election year.

So which is it - do you want the people to have a voice or do you just want to stick it to the Dems?

The President nominates and the Senate confirms. Both are elected by the people and this is an election year.

McConnell stalled Garlands confirmation b/c he wanted to wait to see who would be President. If it was a Democrat and the GOP retained Congress, they'd get a watered down justice that was still a liberal.

The motive was painstakingly obvious. They didn't give a shit about the people having a say. They wanted to make sure they didn't put a D on the bench when they could have an R within a year.
