Pretty cut and dry. What a POTUS said during the campaign is irrelevant. The law above is either valid, and 'a POTUS' has the authority to do the above, or the law above isn't valid..BDKJMU wrote:Doesn't the question needs to be answered if the below portion of 8 USC 1182 is valid or not?GannonFan wrote:
Why do you think they'll even take it? I don't think it's a guarantee at all that it will be taken up by the SCOTUS.
"..(f) Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.."

Seems pretty cut and dry to me. A president either has the ability to ban visas from certain countries as the law clearly states he does, or the law is null and void, no?

None of them even bothered to site any law or precedent

I don't think he will this year. I believe he put in a request for some clerks(?) for the next session which he wouldn't of done if he was retiring. Unless he is trolling everybody.HI54UNI wrote:Just wait until Kennedy announces that he is retiring later this week. Another solid conservative justice will be appointed to replace him. Will Dems be able to forgive Biden for laying the groundwork for all of this to happen (i.e. the idea he pushed that a nominee should not answer questions regarding topics that could come to them as a justice once they're on the court (i.e. what took down Bork but has made confirmation a cakewalk since then) and the idea that a lame-duck President should not name a nominee in the last year of their term if the current Senate is in the other party's hands?)? As for decisions being overturned, any 5-4 decision (or 6-3) have good chances of being overturned in years to come just due to the close nature of the vote. But as another poster said, Kennedy's going to be replaced by someone more to the right than he is, so it could be awhile before the Court moves in another direction.dbackjon wrote:The Stolen SCOTUS seat - every single decision WILL BE overturned, or this country will cease to exist.

I kind of suspect that Kennedy does not like the idea of Trump getting to appoint another Justice and will try to hang on to see if a different President will be elected. Of course Kennedy has limited control over whether he dies or not before a different President takes office. Same with Ginsburg.GannonFan wrote: But as another poster said, Kennedy's going to be replaced by someone more to the right than he is, so it could be awhile before the Court moves in another direction.

Doesn't matter. If you look at the long term the other side is in better position to win in the long term.
It's fine that what I suspected didn't happen. It does surprise me. And it still doesn't matter with respect to the other side winning in the long term. The Democrats will inevitably dominate. It's not a question of if. It's just a question of when. All of the underlying trends are in their favor.AZGrizFan wrote:Good call, John.JohnStOnge wrote:

I know, I was just thinking the same thing. The don’t own the house, senate or presidency (or Supreme Court for MANY years)...they own less than 1/2 the governorships, less than half the state houses and less than half the state legislatures...but the trends are in their favor.JohnStOnge wrote:It's fine that what I suspected didn't happen. Well, if you take the tact of it can't get much worse, then, almost by default, it has to get better. JSO's an optimist that way.AZGrizFan wrote:I know, I was just thinking the same thing.
