Agreed - the police in the Utah case were ultimately in the wrong. The law, especially in Utah, only says that the implied consent is valid if the person who's blood is being sought is reasonably assumed by the police to have been operating the vehicle illegally. The officer in the video specifically says time and time again that they do not suspect the driver of any wrongdoing, he even says they're getting the blood as a way to clear the driver. So in that case, implied consent does not apply. Want the blood? Get his permission or get a search warrant. I hate to disagree with you GF, but with regards to commercial license holders in Utah, that is not what the law states. Anyone who holds a CDL is held to a higher standard than your normal every day licensed individual. For instance, if you or I have a BAC of .08% or more, we are charged with DUI. Utah law explicitly states that, "If you operate a CMV (commercial motor vehicle), you shall be deemed to have given your consent to alcohol testing.". Add to that, the Federal Motor Carrier Safety Administration regulations requiring any commercially licensed driver (at fault or not) to submit to mandated drug testing after an accident involving a fatality. Not to pile on, but you also have exigent circumstances at play in this situation as well. Court after court have held that alcohol metabolizing in the bloodstream qualifies as exigent circumstance for law enforcement to seize evidence (blood) without a warrant.
This situation is much more muddled than most people are wiling to admit. The only way this can truly be settled is in a court of law.

There are a lot of issues being confused and conflated here.
Possession of a CDL, in most states, does carry "implied consent" in the acceptance of that license. In fact, most states have implied consent in the acceptance of regular driver's licenses. This is how state governments suspend your driver's license when you refuse a breath test.
However, this incident doesn't involve implied consent to my knowledge - the driver in question was not being investigated as possibly being at fault in an accident, and he was not suspected of having caused or contributed to the accident.
Secondly, even assuming that the officers could demand blood be drawn from the driver, they were way out of line in making an arrest over it. They could have called the city attorney for a consult, they could have called another command staff officer, they could have come back with a warrant. The right thing happened here- the arresting officer was fired (and he's going to be even money on losing some cash in a civil suit), and the LT was rightfully busted down to patrolman. He may have some vicarious liability in this, too.
Finally, you DON'T arrest ER personnel. Period. ER nurses are your best friends, and ERs are also a cop spouse shopping mall.
