"Judge overturns life without parole sentence for DC sniper Lee Boyd Malvo

WASHINGTON - A federal district court judge has overturned the sentence of Lee Boyd Malvo, one of the two people convicted in D.C.-area Beltway sniper attacks nearly 15 years ago, according to a ruling released Friday.

Malvo was sentenced to life in prison without parole for the sniper-style attacks committed around the region in October 2002 along with John Allen Muhammad. Ten people were killed and three others were shot during a three-week period.

Malvo appealed to the court saying he should not have been sentenced to life without parole because he was 17 years old at the time of the murders and he based his appeal on the Supreme Court ruling in Miller v. Alabama.

The decision in the Supreme Court case ruled juveniles are constitutionally different from adults for the purposes of sentencing "because juveniles have diminished culpability and greater prospects for reform," which makes them "less deserving of the most severe punishments." Judge Raymond Jackson agreed and made his ruling to vacate Malvo's sentence.

Malvo was convicted in one trial in Virginia and entered an Alford plea in another. He had previously filed two motions for writs of habeas corpus that failed.

Now, Malvo's case has been remanded back to Spotsylvania County Circuit Court to issue a new sentence.

Muhammad and Malvo used a rifle to shoot over a dozen people from a modified trunk of a Chevrolet Caprice in random attacks in Maryland, Virginia and D.C.

Fairfax County Commonwealth's Attorney Ray Morrogh, who helped prosecute Malvo in 2003, said the Virginia attorney general can appeal Jackson's ruling. If not, Morrogh said he would pursue another life sentence, saying he believes Malvo meets the criteria for a harsh sentence.

The Virginia Attorney General's Office said in a statement, "We are reviewing the decision and will do everything possible, including a possible appeal, to make sure this convicted mass murderer serves the life sentences that were originally imposed."

Malvo, now 32 years old, is currently being held at Red Onion State Prison, a super-maximum security prison in Virginia.

Philippine police on Sunday identified the gunman behind an attack on a casino that killed 36 people as a heavily indebted local man addicted to gambling, ruling out any involvement by Islamic militants.

The gunman was named as Jessie Javier Carlos, a 42-year old Filipino, who stormed the casino in Manila on Friday, setting gaming tables alight and killing dozens of people who suffocated in thick smoke. Islamic state claimed the attack, but officials insisted it was a botched robbery.

Carlos, whom police described as a "high-roller", killed himself in a hotel room after being shot and wounded by security officers at casino, police said.

"He is heavily indebted due to being hooked on casino gambling, according to his immediate family," Oscar Albayalde, chief of the capital's police office, told a media briefing on Sunday. "He is already addicted, so you are no longer in your right mind when you are addicted."

Albayalde said Carlos, a father of three, had a bank account with an outstanding debt of 4 million pesos ($81,000).

Carlos, whom police described as a "high-roller", killed himself in a hotel room after being shot and wounded by security officers at casino, police said.

"He is heavily indebted due to being hooked on casino gambling, according to his immediate family," Oscar Albayalde, chief of the capital's police office, told a media briefing on Sunday. "He is already addicted, so you are no longer in your right mind when you are addicted."

Albayalde said Carlos, a father of three, had a bank account with an outstanding debt of 4 million pesos ($81,000).

“Prosecutor: ‘No doubt' Harrisburg gunman was targeting police officers

There's "no doubt" a gunman who fired at police in several locations in the state capital, wounding one of them before they shot and killed him, was targeting police officers, a prosecutor said.

Ahmed Aminamin El-Mofty fired at a Harrisburg police officer on Friday afternoon and later at a state trooper, wounding her before pursuing her, Dauphin County District Attorney Ed Marsico said.

"He fired several shots at a Capitol police officer and at a Pennsylvania state police trooper in marked vehicles," Marsico told reporters, flanked by state police, Capitol police and FBI officials.

The gunfire began shortly after 4 p.m. Friday, when the man fired several shots at a state Capitol officer in downtown Harrisburg, striking his car several times and sending one shot "that went very close to hitting him," Marsico said. About 20 or 30 minutes later, he fired several shots at the state trooper, striking her with one of those shots.

The trooper is "doing well," is in good condition and is expected to make a full recovery, Marsico said.

El-Mofty pursued the trooper to a residential neighborhood, where city and state police encountered him.

"He approached them with two handguns ... firing many shots at those police officers," and the officers returned fire, killing him, Marsico said.

El-Mofty had ties to the Middle East and recently traveled there, but the motive for the attack was unknown, Marsico said....”

A SUSPECTED ISIS gunman was shot dead by cops after killing three and injuring a dozen others in a gun rampage and supermarket hostage attack.

The attacker, named by police as 26-year-old Redouane Lakdim, was killed in a hail of bullets after anti-terror cops stormed the Super U store in Trebes, south-east of Toulouse.

Armed with a gun, knives and a grenade, the extremist had earlier hijacked a car, shot its passenger in the head and fired at jogging police officers in nearby Carcassonne.

Lakdim, who was jailed on drug charges in 2016, then drove the stolen car to the supermarket in Trebes where he killed a butcher and shopper before talking as many as 20 others hostage.

Lakdim pledged allegiance to Syria and allegedly screamed "Vengeance for Syria!" during the attack and later demanded the release of Paris attacker Salah Abdeslam....
